Title:ODŠKODNINSKA ODGOVORNOST DRŽAVE ČLANICE ZARADI NESPOŠTOVANJA PRAVA EU - HIBRIDNOST PRAVIL NACIONALNEGA IN PRAVA EU

Abstract:Temeljno načelo odškodninske odgovornosti države zaradi kršitev prava EU je plod dolgoletne prakse Sodišča Eropske unije. Zagotavlja učinkovito uveljavljanje pravic, ki jih posameznikom podeljuje pravo EU v pravnih redih držav članic. Sistema varstva pravic v pravu EU zagotavlja posamezniku neposredno uporabo pravil EU torej pravil, ki niso pravila notranjega prava njegove države članice tako, da se na ta pravila lahko sklicuje neposredno pred domačimi državnimi organi in sodišči. Jedro naloge se ne nanaša na raziskovanje pravic, ki jih pravo EU podeljuje posameznikom, prav tako ni namen te naloge, poglobljeno raziskati pravna sredstva zoper državo članico, domnevno kršiteljico prava EU, pač pa je osrednjega pomena preučitev vpliva kršitev obveznosti, ki so jih s pravnim redom EU prevzele države članice do posameznikov. Magistrska naloga se ukvarja s situacijami v katerih prihaja do nasprotij med pravicami, ki jih posameznikom podeljuje pravo EU in ravnanjem držav članic. Raziskovanje, ali obstaja odškodninska odgovornost države zaradi nespoštovanja prava EU ter raziskovanje predpostavk, ki morajo biti pri tem izpolnjene temelji na sodbah Sodišča EU, ki segajo v različna obdobja razvoja evropske integracije. Pri tem se naloga osredotoča predvsem na odgovornost države za škodo, ki jo lahko s svojim aktivnim ali pasivnim ravnanjem pri implementaciji prava EU povzroči posameznikom.

Title:Member state liability for breach of EU law - hybridity of national rules and EU law
Abstract:Basic principles related to state liability for breach of EU law founded by the Court of Justice of the EU (ECJ) are establishing effective protection of individual Community rights. To enhance such protection, EU law have to be applicable in national legal systems of all mamber states. Accaptence of comman principal of state liabilty in all member states should enhance harmonisation and establish proper guaranties for efficient legal remedies for reimbursement of damages in respect of legislative or judicial acts. This thesis presents European case law concerning state liability and provides short overview of state liability law in Slovenia. Purpose of this paper is to gather information on state liability for breach of Community law. European rules on state liability have been developed mainly because of the problems concerning the enforcement of directives and further on to ensure and strengthen individuals’ rights as well as to close the gap in the area of efficient sanctioning of breaches of EU law. Reference on important legal documents as well as on the court pratice of the ECJ concerning fundamental conditions under which liability arises under EU law, is pointed out. It exsamens in detail the major elements for better understanding and for comprehansive introduction of the principle of state liability, including the following topics: the protection of rights in the European union the principle of state liability for breach of EU law, conditions for the state liability under the EU law, the substantive and the procedural aspect of the liability under the Slovenian legislation, the synthesis of rules on state liability under the EU law and the slovenian legislation, the outcome.
