Title:Zakonodajni vidiki uporabe biometrije v Sloveniji : diplomsko delo visokošolskega strokovnega študija Varnost in policijsko delo

Abstract:V diplomskem delu je obdelana zakonodaja s področja uporabe biometrije, vključeni so primeri uporabe in omenjena sta tudi razvoj in razširjenost uporabe biometrije pri nas in v tujini. Ker zakonodaja omejuje biometrijo predvsem z vidika varovanja zasebnosti, bo govora tudi o zasebnosti. Biometrija je v Slovenji dovoljena le v točno določenih primerih, ki so opisani v odločbah informacijskega pooblaščenca. Za boljšo predstavo o tem, kako je z uporabo biometrije danes in kako je bilo včasih, bomo pogledali tudi zgodovino uporabe biometrije. Zakonodaja s področja biometrije v Slovenji je stroga; po mnenju ponudnikov te tehnologije ena strožjih. V tujini je uporaba biometrije nekoliko manj omejena s strani zakonodajalca, kar pomeni, da je biometrija bolj razširjena kot pri nas. Uporaba biometrije je omenjena in urejena v zakonu o varovanju osebnih podatkov, zakonu o tujcih, zakonu o potnih listinah, zakonu o mednarodni zaščiti, zakonu o državni meji ter zakonu o varstvu dokumentiranega in arhivskega gradiva ter arhivov. Problem uporabe biometrije je varovanje zasebnosti oziroma varovanje osebnih podatkov, saj so ti podvrženi zlorabam. Nekatere biometrične podatke je namreč enostavno ponarediti, zlorabljali pa bi jo lahko tudi delodajalci za nadzor nad zaposlenimi. Vendar imamo v Sloveniji kar se tega tiče dobro zakonodajo, saj ne dopušča uvajanja biometrije po nepotrebnem. Z vidika praktičnosti pa je zakonodaja prestroga, saj je tehnologija že tako napredovala, da obstajajo sistemi, ki nam bi precej poenostavili življenje.

Title:LEGISLATIVE ASPECTS OF THE USE OF BIOMETRICS IN THE REPUBLIC OF SLOVENIA
Abstract:The objective of the present diploma thesis is the legislation regarding the use of biometrics, featuring application examples as well as the development and the current use of biometrics in Slovenia and abroad. Since the legislation has a restricting influence on the field of biometrics, which is mostly due to the protection of the privacy of individuals, the thesis will also discuss the issue of privacy. In Slovenia, biometrics is permitted only in specific cases, which are described in the decisions of the Information Commissioner. For a better understanding of the use of biometrics today and in the past, the thesis will also provide a historical insight into the usage. The Slovenian legislation concerning biometrics is strict; according to the providers of this technology one of the strictest. In other countries, the use of biometric technology is less restricted by the law and consequently more widespread than in Slovenia, where it is restricted and regulated by the following acts: Personal Data Protection Act, Aliens Act, Travel Documents Act, International Protection Act, State Border Control Act, Protection of Documents and Archives and Archival Institutions Act. An issue regarding the use of biometric technologies is the protection of the privacy of individuals or rather the protection of personal data, which is subject to misuse. Some biometrical data can easily be falsified and further on misused by employers to control their employees. For that matter, Slovenia provides a good legislation which does not permit an implementation of biometrics for unnecessary reasons. However, from the practical viewpoint this legislation has proven to be too strict, since the technology has developed to such a degree, that some systems could simplify our lives considerably.
