Title:Problemi mednarodnih kriminalističnih preiskav : diplomsko delo univerzitetnega študija

Abstract:Namen diplomskega dela je bil osvetliti področje mednarodnega kriminalističnega preiskovanja in predvsem predstaviti probleme, s katerimi se soočajo mednarodni kriminalistični preiskovalci. V diplomskem delu je opisan zgodovinski pregled mednarodnega kriminalističnega preiskovanja, trenutno stanje, predvsem na področju mednarodne zakonodaje, mednarodnih organizacij in načinov sodelovanja, ter priložnosti mednarodnega kriminalističnega sodelovanja v prihodnosti. V osrednjem delu diplomskega dela smo se osredotočili na izzive, s katerimi se kriminalistični preiskovalci soočajo pri svojem delu in zaradi katerih lahko pride do manjše učinkovitosti in napak pri preiskovanju ter posledično do nepreiskanih kaznivih dejanj. Skozi diplomsko delo smo potrdili hipoteze, da so pravni viri okvir za mednarodno kriminalistično preiskovanje, a lahko hkrati pomenijo tudi oviro za mednarodne preiskave. Potrdili smo tudi, da pri preiskavah prihaja do mnogih, zelo različnih problemov in da je največji problem mednarodnih preiskav nezadosten pretok informacij med državami ter, da bi skupne preiskovalne skupine lahko pomenile preobrat pri preiskovanju in mednarodnem sodelovanju. Slednje so namreč kot moderen inštrument preiskovanja evropskih preiskovalcev in pravosodnih organov. To trenutno novo, močno orožje, ki ima mnogo prednosti, bi lahko preiskovalcem pomagalo dohiteti in prehiteti storilce kaznivih dejanj in pomagati k večji in učinkovitejši preiskovanja kaznivih dejanj v Evropi.

Title:PROBLEMS OF INTERNATIONAL CRIMINAL INVESTIGATIONS
Abstract:The topic of this thesis was to present the field of international police investigation and the problems that investigators have to confront. The thesis consists of short history of international police investigation, current status on the field of international legislation, international organizations and types of cooperation and future possibilities of international cooperation. The main part of the thesis focuses on the challenges that criminal investigators confront during their work and can cause decrease in efficiency of investigations, investigation mistakes and finally unsolved criminal cases. In the thesis we confirmed the hypothesis that legal documents are the base of the international police investigation, but can also be the obstacle. We also confirmed that the biggest problem of international investigations is insufficient flow of information between countries and that Joint Investigation Teams could improve cooperation in international investigations. These joint investigation teams are new and powerful tool against international criminality and could improve the effectiveness of criminal investigations in Europe.
