Title:Kako delo policije v predkazenskem postopku vpliva na izid kazenskega postopka : diplomsko delo univerzitetnega študija

Abstract:148. člen zakona o kazenskem postopku določa, da se predkazenski postopek začne z aktivnostmi policije, ko so podani razlogi za sum, konča pa se s sklepom preiskovalnega sodnika o preiskavi. S sklepom o preiskavi se nato začne kazenski postopek(V Sloveniji imamo tako imenovani mešani kazenski postopek za katerega je značilno, da je sestavljen iz dveh stadijev, in sicer: predhodni postopek(preiskava in obtoževanje) in glavni postopek (priprave na glavno obravnavo, glavna obravnava s sodbo, postopek s pritožbo, izvršitev sodbe)). V teoriji in praksi se je sicer sprejelo stališče, da se lahko kazenski postopek začne v petih primerih in sicer: s sklepom o preiskavi; s soglasjem preiskovalnega sodnika k predlogu upravičenega tožilca za vložitev neposredne obtožnice; z razpisom glavne obravnave v primeru neposredne obtožnice, za katero soglasje preiskovalnega sodnika ni potrebno z odredbo o vročitvi obtožnega akta v skrajšanem postopku s katerimkoli dejanjem sodnika za mladoletne. Kazenski postopek se nato konča z izvršitvijo sodbe. V diplomskem delu je bilo obravnavano delo policije in kako delo policije v predkazenskem postopku vpliva na izid kazenskega postopka. Ugotovljeno je bilo, da policija pri svojem delu v predkazenskem postopku ni uspešna, saj preišče le 45 odstotkov zaznanih kaznivih dejanj. Če predkazenskem postopku, dodamo še kazenski postopek(in s tem tudi ostale subjekte predkazenskega postopka) lahko ugotovimo, da so policija in ostali subjekti predkazenskega postopka okoli 9,45 odstotno uspešni. Ugotovljeno je tudi, da delo policije v predkazenskem postopku vpliva na kazenski postopek, saj se v predkazenskem postopku zbirajo podatki o kaznivem dejanju, ki imajo kasneje v kazenskem postopku pomembno vlogo pri končni razsodbi.

Title:HOW POLICE WORK IN THE PRE-TRIAL PREJUDICE THE OUTCOME OF CRIMINAL PROCEEDINGS
Abstract:148th Article of the Law on Criminal Procedure provides that a pre-trial process begins with the operations of the police when there are grounds for suspicion, and ends with the decision of the investigating judge on the investigation. Criminal process begins with the decision of the investigation (Slovenia has so-called mixed criminal procedure which typically consists of two stages: pre-treatment process (investigation and blame) and the main process (preparation for the trial, trial with the judgment, appeals, enforcement of the judgment)). In theory and in practice, it is considered that the criminal procedure starts in five cases: by order of the investigation; with the agreement of the investigating judge to the eligible prosecutor's proposal to bring direct charge; by invitation of the trial in the case of a direct indictment to which the consent of the investigating judge is not required; by order of the service charge sheet in summary proceedings; in any action of the judge for juveniles. Criminal procedure ends with the execution of the judgment. In the diploma work has been discussed how police work and police work in the pre-trial, prejudice the outcome of criminal proceedings. It was found that police work in the pre-trial process is not successful, as only 45 percent of detected crimes are investigated. When you add criminal proceedings to pre-trial ,it can be concluded that the police and other subjects of pre-trial are around 9.45 per cent successful. It is also found that the police work in pre-trial affects the criminal proceedings, because in pre-trial information are gained about the crime, which have in later criminal proceedings an important role in the final verdict.
