Abstract:
Avtor v prispevku podaja prikaz razvoja ureditev instituta priposestvovanje lastninske pravice na nepremičninah na področju Slovenije od avstrijskega Občnega državljanskega zakonika - ODZ (Allgemeines Bürgerliches Gesetzbuch - ABGB), preko jugoslovanskega Zakona o temeljnih lastninskopravnih razmerjih - ZTLR do slovenskega Stvarnopravnega zakonika - SPZ. Avtor ugotavlja, da vse ureditve zahtevajo kvalificirano obliko posesti, katero SPZ imenuje dobrovernaposest. Vendar pa SPZ kljub nekoliko drugačni terminologiji ne odstopa od tradicije ODZ. Občutno znižanje priposestvovalne dobe od 30 ali celo 40 let v ODZ do 10 let v SPZ pa gre po avtorjevem mnenju pripisati predvsem prilagoditvi naše razmeroma mlade ureditve vse hitrejšemu razvoju pravnega prometa in vse večji zahtevi po varnosti udeležencev.
