Title:Legalizacija marihuane - nizozemski model : diplomsko delo univerzitetnega študija

Abstract:Marihuana spada v skupino kanabis in s tem med prepovedane droge, čeprav je manj škodljiva od nekaterih legalnih drog kot so alkohol, nikotin, barbiturati ipd. Različni napori preprečiti uživanje, gojenje in promet z marihuano so se izkazali kot neuspešni, saj izgubljamo vojno proti drogam, zato je potrebno najti nov pristop ter namesto represije in poseganja v posameznikovo zasebno sfero uveljaviti tolerantnejšo politiko. Nizozemci so marihuano legalizirali in s tem uredili določene probleme, povezane z uživanjem marihuane. Ker k legalizaciji niso pristopili celovito in uredili vseh vidikov, niso zajezili preprodaje na črnem trgu ali izvoza marihuane iz Nizozemske, ki je neovirano potekal dalje. Organizirane kriminalne združbe torej neovirano služijo naprej. V Sloveniji marihuana ni legalna, zato je v domeni organiziranega kriminala. Število uporabnikov iz leta v leto raste, kriminalci pa služijo, saj so edini, ki marihuano preprodajajo. Če bi Nizozemski model primerno prilagodili, bi ga lahko uporabili v Sloveniji, s tem prevzeli nadzor nad čistostjo droge, nad ponudbo na trgu ter dolgoročno gledano omejili rast števila novih uporabnikov marihuane. Do neke mere bi napolnili proračun, ki je v času recesije več kot samo potreben polnjenja. Žal vodilne politične stranke ne kažejo zanimanja za omenjeno tematiko (vsaj ne iz omenjenega vidika), pripravlja pa se celo posodobitev zakona, ki predvideva še poostren pristop k sankcioniranju uživanja marihuane, kljub temu, da izkušnje drugih kažejo, da je potrebno represivno politiko spremeniti in najti nek ustrezen kompromis.

Title:Legalizacija marihuane
Abstract:Marijuana is a cannabinoid, and thus classified among illicit drugs, in spite of the fact that it is less harmful than some legal drugs, e.g. alcohol, nicotine, barbiturates, etc. Efforts to stop marijuana consumption, growth, and traffic proved unsuccessful. We are losing the war against drugs, therefore a new approach must be found. Instead of repression and interfering with individual privacy, a more tolerant policy should be introduced. The Dutch legalized marihuana and thus regulated certain problems connected with the marijuana use. Yet as their approach towards legalisation was not comprehensive, and not all the aspects were regulated, neither resale of marijuana on black market nor export from the Netherlands were restrained, and continued unhindered. Therefore criminal organisations continue to make profit without impediments. In Slovenia marijuana is illegal and thus in domain of organized crime. The number of users is constantly growing, and the criminals make profit of marijuana, as only they sell it. If the Dutch model were suitably adapted, it could be used in Slovenia. In this way the purity of the drug could be controlled, as well as the offer on the market and, in the long run, the increase of the number of new marijuana users could be restrained. To a certain point the state budget, which in the time of recession sorely needs the income, would be replenished. The leading political parties unfortunately show no interest in the topic (at least not from the mentioned aspect). Quite the opposite, an update of the law is being prepared, foreseeing even tougher approach to sanctioning marijuana use, although the foreign experiences indicate that the repressive policy should be mitigated, and an adequate compromise found.
