Title:Poseg v zasebnost s strani detektivov : magistrsko delo

Abstract:Detektivska dejavnost je gospodarska oziroma storitvena dejavnost, ki je v Republiki Sloveniji regulirana z zakonom. Pri zbiranju informacij, podatkov in dokaznega gradiva se detektivi srečujejo s posamezniki in pri tem posegajo v njihovo zasebnost. Teoretični del magistrskega dela obsega opredelitev zasebnosti, pravice in varstva do zasebnosti, zgodovinski pregled pravice do zasebnosti ter predstavitev ameriškega in evropskega koncepta zasebnosti, kot tudi opredelitev pravice do zasebnosti v slovenskem pravu in njeno kazenskopravno varstvo. Predstavili smo zasebnost na delovnem mestu in opredelili pojem sorazmernosti. V magistrskem delu smo opredelili detektivsko dejavnost v Republiki Sloveniji s poudarkom na upravičenjih detektivov, predvsem na osebni zaznavi in uporabi tehničnih sredstev. Opravili smo primerjalno analizo Zakona o detektivski dejavnosti in drugih zakonov, ki urejajo posege v zasebnosti, to so Zakon o kazenskem postopku, Zakon o slovenski obveščevalno-varnostni agenciji in Zakon o obrambi. Predmet našega proučevanja je poseg v zasebnost s strani detektivov zato smo predstavili nekaj praktičnih primerov posegov v zasebnost pri dveh glavnih detektivskih nalogah, to sta pridobivanje in zavarovanje dokazov pri kontroli bolniških staležev in pridobivanje in zavarovanje dokazov pri zlorabah uveljavljanja stroškov prevoza na delo in z dela. Ker v domači literaturi za enkrat ni zapisanih metod in tehnik detektivskega dela, smo jih glede na pravila kriminalistične stroke poskušali izluščiti in predstaviti, to so opazovanje, sledenje in zasledovanje ter dokumentiranje. Analizirali smo vse relevantne sodbe (judikate in odločbe) sodišč ter opravili intervjuje s strokovnjaki in poznavalci razmer na tem področju. Skozi magistrsko delo (z analizo sodb sodišč in z intervjuji) smo ugotovili, da detektivi pri svojem delu posegajo v zasebnost posameznikov. Ti posegi so zakonsko dovoljeni, največkrat gre za opazovanje, sledenje in zasledovanje in sicer na javnih krajih in z javno dostopnih krajev. Proučevali smo šest hipotez od katerih smo potrdili prvo, drugo, tretjo in peto ter zavrnili četrto in šesto. Potrdili smo, da lahko detektivi zbiranjo informacije in dokazno gradivo z metodami in tehnikami detektivskega dela, kot so opazovanje, sledenje in zasledovanje ter da jih ne moremo enačiti s prikritimi preiskovalnimi ukrepi, ki jih v skladu z zakonom izvajajo službe državnih organov, policija in varnostno-obveščevalne službe. Pri dokumentiranju svojih ugotovitev (dokaznega gradiva) detektivi lahko uporabljajo tehnična sredstva za slikovno snemanje (fotoaparat, video kamero) in poročilo, ki so kot dokazi lahko uporabljeni na sodišču.

Title:INTERFERENCE WITH PRIVACY BY DETECTIVES
Abstract:The detective investigative activity is a commercial or service activity regulated by Slovenian law. When collecting and gathering information data and evidence detectives deal with individuals and impinge upon their privacy. In the theoretical part of this thesis we defined the concept of privacy, the concept of privacy protection and rights and we made a historical overview of the right to privacy. We presented two of the most established concepts of privacy – the European and US concept, as well as the establishment of the right to privacy by the Slovenian criminal law; we presented privacy in the workplace and identified the concept of proportionality. In this work we identified investigative (detective) services in Slovenia with an emphasis on the entitlements of detectives, especially the use of their personal perception and technical resources. We performed a comparative analysis of the Private Detective Act and other laws governing encroachment upon privacy, namely the Law on Criminal Procedure Act, the Slovenian Intelligence and Security Agency Act and the Defence Act. Since the subject of our study is encroachment upon privacy by detectives, we presented some practical examples of privacy intrusions within two main areas of competence of the detective which are - to acquire and preserve evidence in the control of sick leaves and the acquisition and preservation of evidence for the abuse of transport costs enforcement to and from work. Since the overview of domestic literature failed to provide us with methods and techniques of this kind of detective work, we attempted to discern and present the methods of observation, tracking, tracing, and documentation, while following the rules of criminal investigation. We analyzed all the relevant court judgments (judgments and decisions) and we held interviews with experts in this field of work. The overview of this master thesis (including the analysis of court judgments and interviews) confirms, that the detectives in their work encroach upon the privacy of individuals. These practices are legally allowed and are implemented mainly as methods of observation, tracking and tracing in public and within places of public access. Through our academic investigation we studied six hypothesis; we confirmed first, second, third and fifth and rejected fourth and sixth. We confirmed that detectives can collect information and evidence data using observation, tracing and tracking as the methods and techniques of detective work, but these methods at the same time cannot be equaled with hidden investigation practices used by the state authorities, police force and other security or intelligence agencies. In documenting their findings (evidence material), most detectives can use technical aids for visual recording (camera and film camera) and an investigative report, all of which can be used as evidence in the court of law.
