Title:ODŠKODNINSKA ODGOVORNOST DRŽAVE ZA POŠKODBE VOJAKOV MED VOJAŠKO VADBO

Abstract:Avtor se v diplomskem delu ukvarja z vprašanji v katerih primerih in pod kakšnimi pogoji RS odškodninsko odgovarja za ravnanje vojakov in vojake same med vojaško vadbo. Ob tem izpostavlja kot osrednje vprašanje ali država v teh primerih odgovarja po načelu objektivne odgovornosti ali po načelu krivdne odgovornosti. S pomočjo sodne prakse ugotavlja, da oškodovanci večinoma svoj odškodninski zahtevek utemeljujejo na podlagi objektivne odgovornosti, vendar pa iz novejših sodnih odločb in pravnih mnenj Vrhovnega sodišča Republike Slovenije izhaja, da sodniki pri opredelitvi pojma nevarne stvari oziroma nevarne dejavnosti uveljavljajo omejevalni pristop in s tem tudi omejeno uporabo pravil o objektivni odgovornosti. Upoštevajo namreč vse odločilne okoliščine konkretnega škodnega dogodka, pri tem pa imajo še posebej v vidu, da ima RS od leta 1998 poklicno vojsko, torej poklicne vojake, ki so bili sprejeti vanjo zaradi večjih fizičnih sposobnosti ter številnih predhodnih usposabljanj.

Title:CIVIL LIABILITY OF THE STATE FOR SOLDIERS INJURIESDURING MILITARY TRAINING
Abstract:Author of the thesis deals with issues in which cases and under which conditions the Republic is liable for the conduct of soldiers and the soldiers themselves during military exercises. At the same time points as the central question of whether the State in such cases is liable under the principle of strict liability, or the principle of fault liability. With the help of case notes that most victims of its claim on the grounds of strict liability, but in recent court decisions and legal opinions of the Supreme Court of the Republic of Slovenia that the judges in the definition of dangerous things and dangerous activities, and enforce the restrictive approach taken by the limited application of the rules of strict liability. Account all relevant circumstances is a particular loss event, while a particular vision in that the RS of a professional army in 1998, then professional soldiers who have been admitted into the major physical capacity, and number of previous training.
