Title:PRIZNANJE KAZNIVEGA DEJANJA-KRIMINALISTIČNI IN PRAVNI VIDIKI

Abstract:Namen naloge je prikazati pojem priznanja z različnih vidikov in ugotoviti, kakšen vpliv ima na preiskovalce kaznivih dejanj in potek kazenskega postopka. Uvodno poglavje na kratko opisuje, kakšno vlogo ima priznanje v različnih fazah kazenskega postopka. Izpostavljeni so nekateri problemi, ki se lahko pojavljajo pri pridobivanju priznanja in vplivajo na nadaljnji potek postopka. V drugem poglavju je opredeljen pojem priznanja. Na kratko so opisane različne oblike priznanja in razlogi, zaradi katerih storilec prizna dejanje. Prikazan je pomen priznanja v predkazenskem in kasneje v kazenskem postopku. Tretje poglavje opisuje postopek zbiranja obvestil od oseb v informativnem pogovoru, ki je neformalne narave, in postopek zaslišanja, ki je natančno določen in predpisan v zakonu. Omenjeni so nekateri problemi in omejitve, s katerimi se soočajo preiskovalci pri pridobivanju priznanja od domnevnih storilcev. V nadaljevanju je opisano dokumentiranje izjav po koncu zbiranja obvestil ali zaslišanja in predstavljena pravna podlaga, ki omogoča organom pregona zbiranje informacij o kaznivem dejanju in storilcu. Na koncu poglavja je omenjena pravica do zagovornika, ki predstavlja eno izmed temeljnih pravic posameznika in ima pomembno funkcijo v kazenskem postopku. V četrtem poglavju so prikazani vzroki za spreminjanje izjav in preklic priznanja osumljenca ali obdolženca v kasnejšem postopku. Nakazane so možnosti, ki lahko zmanjšajo število spremenjenih izjav in kasnejših preklicev priznanj tako v predkazenskem kot v kazenskem postopku. Peto poglavje na začetku vsebuje splošen opis dokaznega postopka in pomen priznanja v njem. Predstavljeni so vplivi in posledice, ki jih ima priznanje na trajanje dokaznega postopka. V zaključku poglavja sta obravnavani dve pomembni novosti, ki ju prinaša zakonodaja in imata velik vpliv na trajanje in potek dokaznega postopka. Zadnje poglavje podaja sklepne ugotovitve in opisuje prednosti, ki jih prinaša sprememba zakonodaje.

Title:CONFESSION OF CRIMINAL OFFENCE-CRIMINAL INVESTIGATIVE AND LEGAL ASPECTS
Abstract:The purpose of this diploma thesis is to present the notion of confession from various aspects and to determine its effect on criminal act investigators and on the process of criminal proceedings. The introductory chapter in short describes the role of confession in different phases of criminal proceedings. Some problems which may occur while obtaining confession and affect the further process of the proceedings, are exposed. The second chapter defines the notion of confession. Various forms of confession and reasons for the offender to confess are described in short. The importance of confession in pre-trial and later on in trial proceedings are shown. The third chapter describes the procedure of collecting information from persons in an informative talk which is non-formal and the hearing procedure which is specifically determined and stipulated by the Law. Some problems and limitations, faced by the investigators while acquiring confession from alleged offenders, are described. Further on, documenting statements after collecting information or hearing is described and the legal basis which enables the prosecution organs to collect information about the criminal act and the offender, is presented. The right to counsel is mentioned at the end of the chapter. It represents one of the fundamental rights of an individual and has an important function in criminal proceedings. Chapter four shows the reasons for statement modification and withdrawal of confession of the suspect or of the accused in later procedure. Possibilities are suggested that may reduce the number of modified statements and later withdrawals in pre-trial and in trial proceedings. Chapter five contains a general description of evidence procedures and the importance of confession in it. Influences and consequences of a confession on duration of criminal proceedings are presented. Conclusion of the chapter discusses two important novelties introduced by the legislation which have a big impact on duration and on the process of evidence procedures. The final chapter presents conclusions and describes the advantages brought by changes in legislation.
