Title:INSTITUCIONALNI IN FUNKCIONALNI VIDIKI NEODVISNOSTI DRŽAVNEGA TOŽILSTVA

Abstract:Diplomsko delo obravnava najpomembnejša vprašanja institucionalne in funkcionalne neodvisnosti Državnega tožilstva Republike Slovenije, ki je kot del pravosodja samostojen državni organ. Njegova glavna funkcija je pregon storilcev kaznivih dejanj v javnem interesu, ki ga izvajajo državni tožilci, zato je neodvisnost tega državnega organa pomembna za zagotovitev neodvisnosti sodstva in vzpostavitev pravne države. Umestitev državnega tožilstva v okvir izvršilne veje oblasti je na prvi pogled lahko sporna, vendar je takšna umestitev tudi normalna z vidika razmejevanja vlog državnega tožilca in sodnika v postopku. Nikakor pa takšna umestitev državnega tožilstva ne sme pomeniti političnega vpliva na delo državnih tožilcev. Vprašanja, ki so pomembna za delo državnih tožilstev, je pri nas sprva urejal Zakon o državnem tožilstvu iz leta 1994, ki je priznal velik pomen neodvisnosti državnih tožilstev, zato je položaj državnih tožilcev v mnogih pogledih izenačil z položajem sodnikov. Leta 2011 je bil, s ciljem po zagotovitvi večje samostojnosti in učinkovitejše organizacije dela državnega tožilstva, sprejet nov Zakon o državnem tožilstvu, ki prinaša nekatere organizacijske spremembe in posamezne ključne rešitve na področju samostojnosti državnih tožilcev, vendar zakon kljub vzpostavitvi ustreznih mehanizmov ne izpelje v celoti rešitev, za katere je dana podlaga, zaradi česar zakon v posameznih delih zaradi nepopolnih rešitev deluje nekonsistentno, hkrati pa na nekaterih mestih še vedno dopušča možnost, da pride do nedopustnih posegov politike v delo državnih tožilcev.

Title:INSTITUTIONAL AND FUNCTIONAL ASPECTS OF THE INDEPENDENCE OF STATE PROSECUTOR´S OFFICE
Abstract:Diploma thesis deals with the most important questions of institutional and functional independence of State Prosecutor's Office of the Republic of Slovenia which is an independent body in the justice system. Its primary function is public prosecution of criminal offenders which is carried out by state prosecutors. Therefore its independence is important for securing the independency of judiciary and for establishing the Rule of Law. Placement of the State Prosecutor’s office within the executive branch seems to be an impediment to its independence. However, it must be stated that such placement is normal for delimiting the roles of state prosecutors and judges in legal procedures. In no way may this placement imply political influence on the work of state prosecutors. Questions that are important for the work of state prosecutors were first regulated by the State Prosecutor's Office Act which was adopted in 1994 and which recognized big importance of the independence of State Prosecutor's Office by granting state prosecutors similar rights that are granted to judges. In order to guarantee more independence for State Prosecutor’s Office and to organize its work in a more effective way a new State Prosecutor’s Office Act was adopted in 2011. It delivers some organizational changes and some important solutions in the field of state prosecutor’s independence, but despite establishing appropriate mechanisms it does not fully implement solutions that could be implemented within the scopes of these mechanisms. For this reason the new law seems to include some partial solutions and that gives the impression that the new law is inconsistent. At the same time it is evident in some provisions that inadmissible interference of politics in the work of state prosecutors is still possible.
