Abstract:	Zadnja leta v Sloveniji prevladujejo umori med osebami, ki so med seboj sorodstveno, prijateljsko, poslovno ali sosedsko povezane. V porastu so tudi požigi z motivom premoženjske koristi (npr. izplačilo zavarovalnine). Kriminalistično preiskovanje kompleksnih umorov v kombinaciji s požigi oz. požari je zelo zahtevno delo in je hkrati odvisno od znanja in izkušenj preiskovalcev ter pomoči tujih strokovnjakov. Požigi z namenom prikrivanja umora so pri nas prej izjema kot pravilo, vendar obstajajo. Ugotovitev motiva, ki je storilca napeljal na izvršitev kaznivega dejanja umora, predstavlja velik napredek v preiskavi. Če motiva ne odkrijemo, preiskovanje poteka počasneje. Gasilci in reševalci s svojim prihodom močno spremenijo kraj dejanja. Pomembno je, da si do prihoda kriminalistov zapomnijo oz. zabeležijo vse spremembe na območju gašenja in reševanja (nasilni vstop v objekt, odprta okna, položaj najdenih trupel, ipd.). Družinski umori zajemajo največji delež med umori v slovenskem prostoru. Družinski umor je velikokrat posledica dolgotrajnih konfliktov oz. je posledica fizičnega ali psihičnega nasilja znotraj družine. Osnovna naloga policije je odkrivanje in preiskovanje kaznivih dejanj. Najdene in zavarovane sledi v predkazenskem postopku morajo pripeljati do tako visoke verjetosti, da je določena oseba storila kaznivo dejanje, da je zoper njo mogoče vložiti obtožbo. Zelo pomembna faza znotraj kazenskega postopka je dokazni postopek. Vpliv policije na kazenski postopek se je v zadnjih letih povečal. V empiričnem delu diplomskega dela je na resničnem, pravnomočno zaključenem primeru na Okrožnem sodišču v Ljubljani predstavljena celotna analiza kazensko-preiskovalne zadeve (od zbranih prvih obvestil na kraju do izreka sodbe).

Abstract:

In the last years murders in Slovenia were dominated by murders among people who were connected by kinship, friendship, neighborhood or business related. There is also an increase of arsons which motive is some sort of material benefits (i.e. insurance fraud). Criminal investigation of complex murders in combination with arson or a fire is a very demanding job and at the same time depending on the knowledge and experience of the investigators and the assistance of outside experts. In Slovenia concealing a murder with arson is more an exception rather than the rule, but there have been reported cases. Significant progress in the investigation is finding a motive which led the perpetrator to the crime. If the motive is not found the investigation can proceed slowly. Firefighters and emergency medical technicians effect the crime scene with their arrival at the site of the accident (i.e. arson). It is very important that they remember or record any changes made on the crime scene before the arrival of police officers. Such changes might occur because of forced entry into the facility, opening windows, the location of the bodies, etc). Domestic murders represent the largest share of murders in Slovenia. Domestic murder is often a result of protracted conflicts or is the result of a physical or psychological domestic violence. The basic task of police forces is detection and investigation of criminal acts. Evidence found at the scene of the crime during a pre-trial investigation should have a high probability of success against an alleged suspect so that criminal charges can be made. Very important phase within the criminal proceedings is the presentation of evidence. The impact of the police on the criminal proceedings has increased in recent years. In the empirical part of the thesis we will present a case from the District Court in Ljubljana which includes a complete analysis of criminal Investigation starting from the first collected evidence to the reached verdict.
