Title:Primerjava uporabe prikritih preiskovalnih ukrepov v državah EU : diplomsko delo univerzitetnega študija

Abstract:Prikriti preiskovalni ukrepi so v današnjem času, ko je močno razvit organiziran kriminal, ključna sestavina odkrivanja in preiskovanja kaznivih dejanj. Diplomska naloga se nanaša na uporabo prikritih preiskovalnih ukrepov po zakonih, ki jih določa Zakon o kazenskem postopku. V delu so navedene opredelitve posameznih preiskovalnih ukrepov, ki se pojavijo v navedenih državah, in primerjave njihove uporabe in pogoje med državami Slovenije, sosedne države Hrvaške, Nemčije, ki poleg Slovenije predstavlja državo iz EU, Srbije, Kosova, Makedonije in Bosne in Hercegovine, ki so države, v katerih je močno prisoten organiziran kriminal zahodnega Balkana. Primerjajo se med seboj potrebni dokazni standard, ki je potreben za upravičeno uporabo prikritih preiskovalnih ukrepov, kdo jih odredi, rok trajanja in možnost podaljšanja. Prikazano je tudi mednarodno sodelovanje med navedenimi državami, ki se izvaja predvsem prek dvostranskih ali večstranskih pogodb, katera so pomembna predvsem pri čezmejnem organiziranem kriminalu, saj s pomočjo sodelovanja lahko delujejo na več območjih hkrati in pridobijo več koristnih informacij naenkrat. Z analizo primera je prikazano, da je možna uporaba dokazov, ki so bili najdeni v drugi državi pogodbenici dvostranske pogodbe, tudi pri nas, v primeru, da so bili izvedeni po njihovi zakonodaji in ne kršijo človekovih pravic in svoboščin, ki veljajo za vse navedene države. Diplomsko delo pa se zaključi z verifikacijo hipotez in zaključkom.

Abstract:Undercover operations in this day and age, where is developed a strong organized crime, are a key component of detecting and investigating criminal offenses. This thesis concerns the use of covert investigative measures under the laws laid down by the Code of Criminal Procedure. This work provides definitions of particular investigative actions that occur in the countries and a comparison of their use and conditions of countries of Slovenia, Croatia, Germany, Serbia, Kosovo, Macedonia and Bosnia and Herzegovina, where is strongly presented the Western Balkans organized crime. It includes comparison between named countries of required standard of proof, which is needed to use special measurements, who ordered them, time limit and the possibility of extension. It is also shown the international co-operation between those countries which are mainly carried out through bilateral or multilateral treaties, which are particularly important in cross-border organized crime, because through cooperation police can work in several areas simultaneously and obtain more useful information at once. In it is also analyzed the case, which shows that it is possible to use evidence found in the other country in home court, in case that evidence was found under their law, and do not violate human rights, which apply to all those countries. Thesis ends with the verification of hypotheses and the conclusion.
