Abstract:V Evropski uniji vsako leto nastopi skoraj pol milijona dednih zadev s čezmejnimi učinki znotraj držav članic. Več kot 12,3 milijona državljanov Evropske unije živi v drugi državi članici, zato je pričakovati, da bo ta številka še večja. Vsaka država članica ima svoje pravo in vsaka drugače ureja zapuščinske postopke, kar povzroča pravno zmedo. Področje dedovanja na nivoju Evropske unije je popolnoma neurejeno in ne zagotavlja pravne varnosti. Z namenom izboljšanja tega stanja je Komisija predstavila Zeleno knjigo o dedovanju in oporokah, s katero je odprla javno debato o potrebni enotni ureditvi dedovanja v okvirih Evropske unije. Zelena knjiga je naletela na veliko odobravanja. Po napornem in dolgotrajnem usklajevanju je bila sprejeta Uredba (EU) št. 650/2012 Evropskega parlamenta in Sveta, z dne 4. julija 2012, o pristojnosti, pravu, ki se uporablja, priznavanju in izvrševanju odločb in sprejemljivosti in izvrševanju javnih listin v dednih zadevah ter uvedbi evropskega potrdila o dedovanju. Uredba bo močno poenostavila postopke mednarodnega dedovanja znotraj Evropske unije in državljanom zagotovila predvidljivost ter s tem povečala pravno varnost. Bistvena novost je, da se za celoten postopek dedovanja uporablja eno pravo in določi se eno pristojno sodišče. Poleg tega uredba uvaja Evropsko potrdilo o dedovanju, ki bo omogočalo dedičem uveljavljanje njihovih pravic po vsej Evropski uniji, brez kakršnihkoli dodatnih formalnosti. Uredba je del prizadevanj Evropske komisije za izboljšanje pravic državljanov Evropske unije.

Abstract:Every year nearly half a million cross border successions occurs in the European union. With over 12.3 million European Union citizens resident in another Member States, the rules are likely to be of interest to many more. Each member state has separate rules on successions, which lead to a legal maze. Successions are not regulated on the level of the European Union and that does not provide legal security. To improve that situation, the European Commission presented a Green Paper on succession and wills, which has launched a public debate about uniform succession regulations in the European Union. The Green Paper was met with great approval. Finally the European Parliament adopted Regulation (EU) No 650/2012 of the European Parliament and of the Council of 4 July 2012 on jurisdiction, applicable law, recognition and enforcement of decisions and acceptance and enforcement of authentic instruments in matters of succession and on the creation of a European Certificate of Succession. The regulation will simplify procedures of international successions within the European Union and will provide predictability and increase legal certainty. New regulation makes international successions simpler by providing single criterion for determining jurisdiction and applicable law. The regulation introduces a European certificate of succession, which will allow people to prove that they are heirs to and to enforce their rights throughout the European Union, without further formalities. Regulation forms part of the European Commission's continuous efforts to improve the rights of European Union citizens.
