Title:Pravna država v Nemčiji in korupcija : diplomsko delo visokošolskega strokovnega študija Varstvoslovje

Abstract:V prvem delu diplomskega dela sem se osredotočila na pojem pravne države. Predstavila sem pojem in naravo ter koncept splošno, potem sem se opredelila na pravno državo v Nemčiji. Po proučevanju literature sem ugotovila, da se je ideja pravne države pravzaprav začela v državi Nemčiji s pojavom neformalnih institucij, ki so se skozi čas spreminjale in dopolnjevale. V nadaljevanju sem predstavila koncept in tipologijo institucij v Nemčiji, odnos med formalnimi in neformalnimi institucijami in poglavje pravne države zaključila z razlago karakterističnih sredstev institucij, ki se uporabljajo kot grožnja za politične odločitve. V naslednjem delu diplomskega dela pa sem opredelila korupcijo, na kratko predstavila problem le-te v Sloveniji in Nemčiji in s pomočjo podatkov mednarodne organizacije o odkrivanju korupcije analizirala stanje problema korupcije v omenjenih državah čeprav je korupcija v večini primerov prikrita, zato jo stežka odkrivamo, še težje je stvar dokazati, saj gre največkrat za podkupnino iz roke v roko. Zaradi visoke stopnje korupcije v obeh državah trpi zaupanje v koncept pravne države, saj nam tudi mediji skoraj vsak dan ponujajo različne zgodbe (bodisi resnične, bodisi gre samo za sum) o pojavu korupcije. Ljudje tako postajajo vedno bolj skeptični, ob večini političnih premikov izkazujejo svoje nezaupanje z različnimi karakterističnimi sredstvi. Vendar pa se ljudje ne zavedamo, da bi s krepitvijo pravne države, z zaupanjem, s skupno močjo lahko veliko prispevali k preprečevanju korupcije ali vsaj k omejevanju. Če bi upali spregovoriti.

Title:RULE OF LAW IN GERMANY AND CORRUPTION
Abstract:. In the first part of the thesis, I focus on the concept of the rule of law. First I presented the concept and the nature of it in general, and then I moved to the rule of law in Germany. After studying the literature, I found out that the idea of the rule of law actually began in Germany with the emergence of informal institutions which have changed and complemented themselves over time. Then I presented the concept and typology of institutions in Germany, the relationship between the formal and informal institutions and finished the chapter of the rule of law with the interpretation of the characteristic resources of those institutions which are used as a threat to political decisions. In the next part of the thesis I have defined corruption, briefly presented the problem of it in Slovenia and Germany and with the help of international organization based on the detection of corruption, I analyzed the situation of the problem of corruption in these countries; but in most cases corruption is hidden which is why it is difficult to discover it and even more difficult to prove it, because it often goes for a bribe from hand to hand. Due to the high level of corruption in both countries people have doubts about the concept of the rule of law. One of the reasons is also the media which almost every day offer a variety of stories about the occurrence of corruption; whether real or only suspected. People are becoming more and more skeptical and in most political movements demonstrate their distrust with different characteristic means. However, people do not realize that with working together, with trust and with the strengthening of the rule of law we can all contribute to the prevention or at least limitation of corruption.
