Title:PRISTOJNOSTI INFORMACIJSKEGA POOBLAŠČENCA S PODROČJA VARSTVA OSEBNIH PODATKOV

Abstract:Varstvo osebnih podatkov je v Sloveniji ena izmed ustavno zagotovljenih pravic in temeljnih svoboščin. Področje je zaradi razvoja informacijske tehnologije široko in v nenehnem spreminjanju. Temeljni zakon s tega področja je Zakon o varstvu osebnih podatkov /ZVOP-1/ (Uradni list RS, št. 86/2004). Leta 2005 pa je stopil v veljavo tudi Zakon o informacijskem pooblaščencu /ZInfP/ (Uradni list RS, št. 113/2005), ki je ustanovil nov samostojen in neodvisen organ Informacijski pooblaščenec, ki ima pooblastila za izvajanje določb s področja varstva osebnih podatkov. Organ je neodvisen, kar pomeni, da zoper njegove odločitve niso možne pritožbe v okviru rednih pravnih sredstev, ampak upravni spor. Upravni spor je sodobna kontrola dokončnih upravnih aktov, izdanih v upravnem postopku. Informacijski pooblaščenec je, tako kot drugi organi, zaradi vstopa Slovenije v EU dolžan spoštovati direktive in sodelovati pri različnih nadzornih in posvetovalnih komisijah v EU. Njegove pristojnosti so vse prej kot skromne, skrbno pripravljeno letno poročilo pa je še en dokaz o odličnem delu tega državnega organa. Pristojnosti Informacijskega pooblaščenca zasledimo v različnih zakonih (npr.: Zakon o elektronskih komunikacijah /ZEKom/ (Uradni list RS,št. 43/2004), Zakon o pacientovih pravicah /ZaPacP/ (Uradni list RS, št. 15/2008), Zakon o osebni izkaznici /ZOIzk/ (Uradni list RS, št. 75/1997), Zakon o potnih listinah državljanov Republike Slovenije /ZPLD-1/ (Uradni list RS, št. 65/2000) ), največ pa jih najdemo v Zakonu o varstvu osebnih podatkov /ZVOP-1/ (Uradni list RS, št. 86/2004). Glavni del diplomske naloge je namenjen proučitvi pristojnosti po ZVOP-1. Šele s podrobnejšo analizo zakonskih določb ZVOP-1 lahko namreč ugotovimo, kakšne so pristojnosti Informacijskega pooblaščenca. Pomembna razlika glede varstva osebnih podatkov je vzpostavljena med javnim in zasebnim sektorjem; varstvo na podlagi ZVOP-1 se nudi zgolj podatkom, pri katerih gre za obdelavo osebnih podatkov. Inšpekcijski postopek je treba ločiti od prekrškovnega, vendar ju združuje dejstvo, da v obeh primerih Informacijski pooblaščenec preverja upoštevanje določb, ki urejajo varstvo osebnih podatkov. V okviru inšpekcijskega nadzora izda upravno odločbo (sodno varstvo – tožba na upravno sodišče), v okviru prekrškovnega postopka pa izda odločbo o prekršku (opomin, globa, sodno varstvo na okrajnem sodišču). Na drugi stopnji zoper odločbe Informacijskega pooblaščenca odločata različna organa, torej nastane problem, če prideta do različnih zaključkov. Informacijski pooblaščenec sodeluje na vseh področjih, kjer se nahajajo osebni podatki. Ima pristojnosti sodelovati pri nastajanju pravnih pravil, vlaganju zahtev za presojo ustavnosti in zakonitosti na Ustavnem sodišču RS, podajanju neobveznih mnenj, odloča o pritožbah posameznikov, je inšpekcijski in prekrškovni organ. Informacijski pooblaščenec si prizadeva, da bi pomembnost in krhkost osebnih podatkov približal širši javnost, vse več vloženih zahtev na urad pa prav gotovo dokazuje, da dela v pravi smeri. Poudariti je treba tudi, da je zoper odločbe Informacijskega pooblaščenca sproženih razmeroma malo upravnih sporov na Upravnem sodišču RS, kar kaže na transparentnost in odprtost delovanja urada ter na sprejemanje odločb Informacijskega pooblaščenca s strani drugih.

Title:Jurisdiction of the Information Commissioner regarding the protection of personal data.
Abstract:Jurisdiction of the Information Commissioner regarding the protection of personal data is one of the constitutionally guaranteed rights and fundamental freedoms in Slovenia. Due to information technology is this field wide-ranging and daily in the emerging and changing. The basic law from this field is the Personal Data Protection Act. The Law on Information Delegate, which has created a new autonomous and independent authority called Information Commissioner that has powers for the implementation of the provisions in the field of protection of personal data, has also entered into force in 2005. Authority is independent and that means that it is not possible to appeal against its decisions within the framework of the regular legal remedies, but the administrative dispute. The administrative dispute is outside the modern control the final administrative acts issued in legal proceedings. As other bodies, Information Commissioner is due to the entry of Slovenia into the EU, obliged to comply with the directive and to participate in the various supervisory and consultative committees in the EU. Its responsibilities are all less than modest, carefully prepared annual report is another evidence of the excellent part of this national authority. The powers of the Information Commissioner can be traced back in the various laws (e.g.: the Law on Electronic Communications, the Law on Patients' Rights, the Law on the Identity Card, the Law on Travel Documents of Citizens of the Republic of Slovenia, the Law on Banking, etc.), most of them can be found in the Personal Data Protection Act. The main part of my diploma thesis is devoted to examining the jurisdiction of the Personal Data Protection Act. With a detailed analysis of the legislative provisions of the Personal Data Protection Act we can figure out what are the powers of the Information Commissioner. Significant difference regarding personal data protection has been established between the public and private sectors, security on the basis of Personal Data Protection Act is providing only data for which goes to the processing of personal data. In the context of inspection is an administrative decision (judicial protection-action in administrative court) issued, in the framework of the offence procedure is a decision on the misdemeanour (reminder, fine, judicial protection in the District Court) issued. Therefore, at second instance against the decision of the Information Commissioner are different bodies, the problem occurs if they come to different conclusions. Information Commissioner participates in all areas where personal data occur. Powers has to participate in the formation of legal rules, the filing requirements for the assessment of the constitutionality and legality of the Constitutional Court of Slovenia, expressing optional opinions, decisions on the complaints of individuals, it is an offence and the authority. Information Commissioner seeks to importance and brittleness of the personal data to the general public, the submitted requests to the Office demonstrates that they are working in the right direction. We should also emphasize that it is against the decision of the information the person instituted a relatively little administrative disputes in the Administrative Court of the RS, which shows on the transparency and openness of the functioning of the Office and to take decisions in the Information Commissioner by others.
