Title:TRIDIMENZIONALNE BLAGOVNE IN STORITVENE ZNAMKE: PRAVNA UREDITEV V EU IN ZDA

Abstract:Diplomska naloga analizira pravni položaj tridimenzionalne znamke znotraj skupine netradicionalnih znamk in pogoje za njeno registracijo. Temeljna predpisa, ki na ravni Evropske Unije urejata tridimenzionalno znamko sta Direktiva 2008/95/ES Evropskega parlamenta in Sveta o približevanju držav članic v zvezi z blagovnimi znamkami ter Uredba Sveta (ES) št. 207/2009 o blagovni znamki EU. Pri obravnavi tridimenzionalne znamke je avtorica upoštevala obsežno judikaturo Sodišča EU. Tridimenzionalno znamko je obravnavala tudi z vidika ZIL-1. Diplomska naloga vključuje primerjavo tridimenzionalne znamke v EU s pravnim institutom “trade dress”, ki se je razvil v Združenih državah Amerike. Njegova pravna podlaga je Lanham (Trademark) Act. Skozi diplomsko nalogo je ugotovljeno, da imajo prijavitelji tridimenzionalne znamke mnogo težav pri izpolnitvi zahtev za registracijo, zlasti pri dosegu zadostnega razlikovalnega učinka, ter da je v obeh pravnih sistemih, tako v EU kot tudi v ZDA, še prostor za izboljšave.

Title:THREE-DIMENSIONAL TRADE MARKS: LEGISLATION IN THE EU AND THE U.S.
Abstract:This thesis analyzes the legal status of three-dimensional marks within the group of non-traditional marks and requirements for their registration. There are two fundamental acts that regulate the three-dimensional marks at the European Union level. One is the Directive 2008/95/EC of the European Parliament and of the Council to approximate the laws of the Member States relating to trade marks. The other is The Council Regulation (EC) No. 207/2009 on the Community trade mark. When discussing the three-dimensional marks the author took the extensive case law of the ECJ into consideration. The author also discussed three-dimensional marks from the perspective of ZIL-1. The thesis includes a comparison of three-dimensional trade marks in the EU with the legal institution of trade dress, which was developed in the United States. Its legal basis is the Lanham (Trademark) Act. The thesis finds that applicants of three-dimensional marks have many problems in fulfilling the requirements for registration, particularly in achieving sufficient distinctiveness. Furthermore, it is found that in both legal systems, in the EU and the US, there is room for improvement.
