Title:LIKVIDACIJA, STEČAJ IN PRISILNA PORAVNAVA V REPUBLIKI SLOVENIJI

Abstract:Gospodarstvo je v prenesenem pomenu kot življenje v katerem se rojevajo nova podjetja in odmirajo stara. To rojevanje in odmiranje podjetij poteka v določenih ciklih v katerih lahko zasledimo, da v času gospodarske rasti nastane več novih podjetij ter v času gospodarske krize pa več podjetij preneha s svojim obstojem. Tako kot v življenju tudi v gospodarstvu veljajo pravila, ki se jih naj bi držali. Nastajanje in odmiranje podjetij v gospodarstvu reguliramo s pravnimi normami s katerimi želimo omogočiti transparentno poslovanje ter enake pogoje za vsa podjetja na trgu. Kadar podjetje zaide v finačne težave in je na meji svojega obstoja, takrat za to podjetje začnejo veljati pravna pravila iz Zakona o finančnem poslovanju, postopkih zaradi insolventnosti in prisilnem prenehanju (ZFPPIPP). Ta zakon ureja postopke in pravila, ki veljajo za podjetja, ki so insolventa ali gredo v prisilno poravnavo oziroma v stečaj. Za obstoj podjetij pa so potrebne tudi banke, katere servisirajo gospodarstvo z krediti in jim omogočajo nadaljni razvoj ali obstoj na trgu. Vendar se pa lahko tudi zgodi, da banke, ki precenijo gospodarske razmere zaidejo v finančne težave zaradi nepremišljenega poslovanja. V primeru finančnih težav lahko gre banka v likvidacijo ali v stečaj in to področje ureja Zakon o bančništvu (ZBan-1).

Title:LIQUIDATION, BANKRUPTCY AND CUMPULSORY SETTLEMENT IN REPUBLIC OF SLOVENIA
Abstract:Economy is like life in general, there are companies being born and companies that cease to exist. These births and deaths of companies are following particular cycles – in times of economic boom more companies are established and in times of economic gloom more companies are ending their existences. As in life, there are rules in economy that have to be followed. The creation and death of companies in a certain economy are regulated by legal norms that enable transparent operation and equal conditions for all companies in a certain market. When a company finds itself in financial distress and on a brink of ending their existence, they have to follow Zakon o finančnem poslovanju, postopkih zaradi insolventnosti in prisilnem prenehanju(ZFPPIPP) in Slovenian legal system. This law sets the rules and procedures for companies facing insolvency or entering settlement and/or bankruptcy. Banks are also a crucial part of every economy as they are serving companies with credit and enabling further development and existence on the market. It can also happen that banks overestimate economic climate and are faced with financial turmoil because of bad business decisions. In case of financial difficulties banks can be liquidated or enter bankruptcy and those areas are regulated by Zakon o bančništvu (ZBan-1).
