Title:Slaba vera prijavitelja znamke in primer Lindt

Abstract:Leta 2009 je Sodišče EU v primeru Lindt prvič postavilo smernice za razlago pojma slabe vere, ki se pojavlja v zakonodaji EU in nacionalni zakonodaji na področju prava znamk kot razlog za njeno prenehanje. Pred tem so se v literaturi in sodni praksi pojavljali različni pristopi k razlagi, Sodišče EU pa je s svojo interpretacijo postavilo temelje za enotnejšo razlago v prihodnosti. Namen diplomske naloge je predstaviti in presoditi nove smernice in njihovo uporabo v primeru Lindt. V pričujočem delu ugotavljamo, da so smernice, ki jih je podalo Sodišče EU, zelo široke, zato ni nujno, da bodo interpretacije nacionalnih sodišč držav članic enotne. Je pa Sodišče EU jasno določilo, da so za presojo slabe vere relevantne vse upoštevne okoliščine zadevnega primera, iz česar sledi, da se bo slaba vera tudi v prihodnje presojala od primera do primera in s posebnim ozirom na okoliščine, ki jih je izpostavilo Sodišče EU. To so prijaviteljeva vednost o obstoječi uporabi enakega znaka, prijaviteljev namen preprečiti tretji osebi nadaljnjo uporabo ter stopnja pravne zaščite, ki jo uživata znak tretje osebe in prijaviteljev znak. Odločba v zadevi Lindt bo zato nedvomno imela velik vpliv na konkurenco na skupnem notranjem trgu.

Title:Bad faith of a trade mark applicant and the Lindt case
Abstract:In 2009, in a dispute between the Lindt & Sprüngli corporation and family owned Franz Hauswirth, the European Court of Justice established the guidelines to assess bad faith for the first time. Bad faith serves as one of the grounds for annulment in both Regulation on Community Trade Mark and the Directive regarding trade marks. Beforehand, national courts and a few authors tried to define bad faith with various approaches but it was the ECJ judgement that set the rules for a consistent approach in the future. The goal of this thesis is to present and assess the newly established guidelines and their application in the Lindt case. Assessment of the judgement reveals that ECJ took a relatively broad approach when establishing the guidelines. Therefore, there is no guarantee that national courts will follow the same approach and interpret bad faith in the same way. On the other hand, ECJ did state clearly that all relevant circumstances must be taken into account. Ergo, bad faith is to be assessed case by case and with particular reference to circumstances that ECJ highlighted: the existence of prior use by third parties and the applicant's familiarity with this fact, the applicant's intention to prevent continued use by such third parties, and the degree of legal protection enjoyed by the third party's sign and by the applicant's sign. To sum up, judgement in the Lindt case will undoubtedly affect competition in the common internal market.
