Title:Tajni podatki - monopol države nad informacijami? : diplomsko delo visokošolskega strokovnega študija Varnost in policijsko delo

Abstract:Sodobne demokratične ureditve težijo k čim večji transparentnosti delovanja državnih organov in so pravo nasprotje absolutističnih državnih ureditev, kjer je bilo glavno vodilo načelo tajnosti, arcana imperii. Z gibanjem razsvetljenstva v 18. stoletju je načelo javnosti vedno bolj spodrinjalo načelo tajnosti do danes, ko je državna tajnost lahko le izjema. V demokratični ureditvi je obstoj državnih tajnosti pogojen s strogo zakonsko regulativo področja in strogim nadzorom. Koliko pa so informacije o delovanju državnih organov dostopne javnosti, je odvisno od dejavnikov razvitosti demokracije v neki ureditvi, od učinkovitosti pravne države in moči civilne družbe. Ti dejavniki vplivajo prav tako tudi na možnost zlorabe instituta tajnosti in na manipulacijo s tajnimi podatki. Hipotetično se to lahko dogaja v vseh državnih ureditvah, vendar so prav omenjeni dejavniki tisti, ki določajo obseg morebitnih zlorab. Slovensko ureditev področja državnih tajnih podatkov in dostopa do informacij javnega značaja lahko štejemo med sodobne demokratične ureditve. Dostop do informacij javnega značaja je že ustavno zagotovljena pravica. Celotno področje informacij javnega značaja je zakonsko urejeno, prav tako tudi področje tajnih podatkov. Poleg zakonske ureditve so vzpostavljeni tudi ustrezni mehanizmi, ki omogočajo izvajanje zakonov, ustanovljen pa je tudi neodvisni državni organ, ki deluje kot pritožbeni organ na področju dostopa do informacij javnega značaja.

Abstract:Modern democratic governments are striving to maximize the principle of transparency of state bodies, in contrast to absolutistic regimes which were guided by the principle of state secrecy, arcana imperii. With the movement of the enlightenment in the 18th century, the principle of transparency started to replace the principle of state secrecy, which has continued to this day, when classified information is only an exception to the rule. The existence of classified information in a democratic society is a subject of strict legal regulation and close supervision. The extent to which the government information about the functioning of state bodies is available to the public depends on the development of democracy, the rule of law and the power of the civil society. These factors also influence the possibility of the abuse of the institution of state secrecy and manipulation of classified information, which hypothetically may occur in all democratic governments and state bodies, yet the factors mentioned determinate the concrete extent of potential any abuse. Slovenian government's regulation of classified information and access to public records may be regarded as a modern, democratic regime, with the access to public records being a constitutionally guaranteed right. Both area of public records and the field of classified information are legally regulated. In addition to legal regulation, appropriate mechanisms for the implementation of the laws and an independent government body that acts as a body of appeal in the field of access to public records have also been established.
