Title:UPORABA POSREDOVANJA ZA REŠEVANJE MEDNARODNIH KONFLIKTNIH SITUACIJ - PRIMER ARGENTINSKO-ČILSKEGA MEJNEGA SPORA

Abstract:Sredstva mirnega reševanja sporov, vsebovana v Ustanovni listini OZN, lahko na splošno razdelimo na diplomatska in pravna. Splošna načela mednarodnega prava, zapisana med drugim tudi v Ustanovni listini OZN, nalagajo državam, da rešujejo medsebojne spore na miroljuben način in da se pri tem vzdržijo grožnje s silo ali uporabe sile. Posredovanje spada med diplomatska sredstva, katerih skupna značilnost je nezavezujoča narava in da uporaba prava ni nujna podlaga za rešitev mednarodnega spora. Posredovanje je proces reševanja meddržavnih sporov, ki vključuje tretjo stran, ki poseže v sam spor in si prizadeva uskladiti nasprotujoče si interese sprtih strani ter poiskati skupno vzajemno rešitev. Gre za enega najpogosteje uporabljenih mehanizmov za reševanje mednarodnih konfliktov. Spor med Argentino in Čilom glede dela ozemlja, nad katerim sta imeli obe strani izključujoče si interese, bi lahko imel katastrofalne posledice, če se ne bi spor razrešil s posredovanjem. Državi sta za posrednika izbrali Vatikan, ki je užival visoko moralno avtoriteto v obeh državah. Sam proces se je zaključil s premirjem, ki traja še danes. Z vidika preučevanja posredovanja gre za izjemen primer, ki je vključeval veliko strategij in tehnik, ki omogočajo podrobnejše razumevanje samega procesa posredovanja.

Title:INTERNATIONAL CONFLICT MEDIATION: CASE STUDY OF ARGENTINIAN-CHILIAN BORDER CONFLICT
Abstract:The means of peaceful settlement of disputes contained in the United Nations Charter can in general be divided into diplomatic and legal means. General principles of international law, written among other also in the United Nations Charter, impose upon countries to resolve their disputes in a pacific manner and to refrain from the threat or use of force. Mediation is considered to be a diplomatic means of dispute resolution , whose common feature is that it is not legally binding for the states and that the resolution of the international dispute is not necessarily based on the substantive law. Mediation is a process of dispute settlement which includes activities of a third party who intervenes in the dispute and makes efforts to harmonize the opposing interests of parties involved in the dispute and thus to come up with a solution acceptable to all parties in the conflict. Mediation has been one of the most commonly used mechanisms of international dispute settlements . The dispute between the Argentine Republic and the Republic of Chile concerning the part of the territory over which both parties claimed to have excluding interests could have led to catastrophic consequences, if the Pope had not met the request for his mediation . Given that the Pope was held in high esteem by both states and also enjoyed high moral authority on either side, the Vatican was chosen to mediate in the concrete border dispute. The process itself resulted in a truce which is in place still today. From the viewpoint of mediation studies it represents an exceptional case in which many strategies and techniques were employed, what allows for much better understanding of the mediation process itself.
