Abstract:Informacije javnega značaja predstavljajo ključno orodje nadzora javnosti nad delovanjem države in njenih institucij. S prostim dostop do njih se uresničuje načelo demokratične države. Dostop do informacij javnega značaja danes zagotavljajo in urejajo mednarodni pravni akti, ustave in posledično tudi notranje pravo držav. Z njim je posamezniku omogočeno uživanje temeljne človekove pravice – pravice vedeti. Prost dostop do informacij, ki jih poseduje javna uprava, zagotavlja javnost in odprtost delovanja njenih organov ter omogoča uresničevanje pravice posameznikov in pravnih oseb, da pridobijo tovrstne informacije. Dostop je mogoče tudi omejiti, in sicer z absolutnimi ali relativnimi razlogi za izjeme pri dostopu, ki na eni strani ščitijo interes posameznika oziroma države, na drugi pa omogočajo razkritje zahtevane informacije, kadar javni interes za razkritje prevlada nad interesom za zaščito varovane informacije. Demokratična ureditev temelji na enakosti vseh, zato je razlikovanje na osnovi katerekoli osebne okoliščine, torej diskriminacija, zanikanje demokratične družbe. V povezavi z diskriminacijo v zaposlovanju govorimo o pravici do dela, o pravici do enake obravnave in o zagotavljanju enakih možnosti. Pravica do dela je osnovna človekova pravica, ki jo omogočamo tudi s protidiskriminacijsko zakonodajo in z iz nje izhajajočimi ukrepi. Izredno pomembno je preprečevanje in pravočasno zaznavanje diskriminacije, ki se pojavlja na vseh družbenih ravneh in v različnih oblikah, zato govorimo o neposredni in posredni, strukturni, sistemski ali institucionalni in večplastni diskriminaciji. Pri zaposlovanju, kljub sprejetim zakonskim normam, obstaja diskriminacija tako pred kot tudi v času zaposlitve ter pogosto še po prenehanju delovnega razmerja. Pomemben institut preprečevanja diskriminacije pri zaposlovanju, predvsem v javnem sektorju, predstavlja prost dostop do informacij javnega značaja. Dostopnost informacij o izbirnih postopkih kandidatov pri zaposlitvi, podatkih o plačah in dodatkih, postopkih ter izpolnjevanju pogojev za napredovanje in napotitev na šolanje pomaga posamezniku, da si v primerih, ko do diskriminacije pride, svojo pravico lahko izbori sam. Dostop do informacij javnega značaja mu namreč omogoči in bistveno olajša zbiranje dokumentacije v neformalnih, upravnih in sodnih postopkih. Prost dostop pa žal ne seže na področje zasebnega sektorja, za katerega velja načelo podjetniške svobode, ki delavcu vseh navedenih možnosti, povezanih z dostopom do informacij javnega značaja, ne zagotavlja.

Title:THE IMPORTANCE OF ACCES TO PUBLIC INFORMATION FOR THE PREVENTION OF DISCRIMINATION IN EMPLOYMENT
Abstract:Public information is the key tool of public control over the operation of the state and its institutions. Free access to public information implements the principle of a democratic state. Access to public information is nowadays provided and regulated by international legal acts, constitutions and, consequently, internal law of individual countries. It provides individuals with the ability to enjoy the basic human right - the right to know. Free access to information by public authorities provides for the public and open character of its bodies’ operation, and enables the exercise of individuals’ and legal entities’ right to acquire such information. Access can also be limited with absolute or relative grounds for exceptions to access, which on the one hand protects the interests of the individual and the state, and, on the other hand allows the disclosure of the requested information, whenever public interest in disclosure outweighs the interest to protect the secured information. Democratic regime is based on equality for all, thus the distinction on the basis of any personal circumstance, therefore discrimination, is considered denial of a democratic society. In relation to discrimination in employment, we talk about the right to work, the right to equal treatment and the provision of equal opportunities. The right to work is a fundamental human right, which is also enabled by anti-discrimination legislation and the measures arising from it. The prevention and early detection of discrimination occurring at all levels of society and in various forms is extremely important, we thus talk about direct and indirect, structural, systemic or institutional and multiple discrimination. With regard to employment, despite the adopted legal norms, discrimination remains both before and during employment, and often even after the termination of employment. Free access to public information is an important instrument of preventing discrimination in employment, particularly in the public sector. Accessibility to information on the employment selection procedures, information on salaries and allowances, procedures and eligibility for promotion and referral to education, help individuals to assert their own rights in cases when discrimination occurs. Access to public information very much facilitates the collection of documents in informal, administrative and judicial proceedings. However, free access is, unfortunately, not relevant to the private sector, where principle of entrepreneurial freedom applies, not providing the worker with access to public information.
