Title:Vloga sodne medicine pri preiskovanju krvnih deliktov : diplomsko delo univerzitetnega študija

Abstract:Pričujoče diplomsko delo predstavlja prepletanje in soodvisnost dveh različnih disciplinarnih vej – sodne medicine in kriminalistike – pri preiskovanju t. i. krvnih deliktov, kot te opredeljuje Kazenski zakonik Republike Slovenije. Sodobne preiskovalne metode namreč pri obravnavi kaznivih dejanj zoper človeško telo v veliki meri temeljijo prav na ugotovitvah sodne medicine. V prvem delu diplomskega dela je najprej predstavljen kratek zgodovinski pregled razvoja sodne medicine na splošno, za tem pa v Sloveniji, opredeljeni so tudi osnovni pojmi, ki se uporabljajo v kontekstu sodne medicine: krvni delikti, orožje, smrt, mrliškopregledna služba, obdukcija, izvedenstvo, biološke sledi. Naslednji, obsežnejši del je posvečen natančnejšemu popisu različnih vrst telesnih poškodb, predvsem s stališča informacij, ki jih lahko oblika poškodbe daje o načinu povzročitve le-te ter uporabi orožja pri njenem nastanku. Sledi poglavje, ki podrobneje obravnava vlogo sodne medicine pri posameznih korakih preiskave, od najdbe trupla pa vse do sestave obdukcijskega zapisnika. Posebej je obravnavana vloga sodne medicine v primerih zadušitev, utopitev in kvalificiranega kaznivega dejanja detomora. Zadnje poglavje opisuje vlogo sodne medicine pri preiskavah prometnih nesreč s hudim in posebno hudim izidom. V zadnjem delu je prostor za preverjanje zastavljenih hipotez ter zaključne misli o nerazdružljivosti medicinske in kriminalistične stroke v simbiozi moderne forenzične znanosti.

Abstract:The following diploma thesis aims to demonstrate the interweaving and interdependence of two very different disciplinary branches – namely forensic medicine and crimonology – in the field of investigation of violent crime as defined by the Penal code of the Republic of Slovenia. This is an important aspect of modern criminology, as investigation techniques are often dependent and in many instances based on forensic investigation methods, especially in crimes against the integrity of the human body. The first part of the thesis is focused on a short historic review of the developement of forensic medicine in general and specifically in Slovenia. The basic terms and concepts used in both sciences are presented: offence against the person , weapons, death, coronary investigation services, autopsy, forensic expertise, biological traces and others. The next part is dedicated to a detailed description of the various types of body injuries, mainly from a standpoint of the information that the type of injury can provide about the manner of its infliction and the specific type of potential weapons used. The following chapter aims to depict the various roles forensic medicine plays in the steps and phases of a criminal investigation, from the discovery of a body to a complete criminal autopsy. Special attention is dedicated to describing specific causes of death, such as suffocation, drowning and infanticide, the last chapter dealing with fatal traffic (car) accidents. The thesis hypothesis are tested in the last part of this diploma and a short review sheds light on why forensic medicine and criminology are indivisible in the modern simbiosis of forensic science.
