Title:Varstvo otrok in mladostnikov v medijskem pravu ( primerjalno pravni pregled)

Abstract:S pojmom varstva otrok v medijskem pravu je mišljeno varstvo mladoletnih oseb pred medijskimi vsebinami, ki škodljivo vplivajo ali bi lahko vplivale na njihov telesni, moralni ali psihični razvoj. Z razvojem tehnologije medijem dandanes ne gre ubežati, ni pa vsa vsebina primerna za otroke, ki so posebej dojemljivi za sporočila, ki jih mediji prenašajo. Pravno podlago varstva otrok pred neprimernimi medijskimi vsebinami najdemo že na mednarodni ravni, kjer se dopušča omejitev svobode izražanja za varstvo drugih pomembnejših vrednot in pravic. Podrobnejše določbe je uveljavila Evropska Unija, ki se po večini navezujejo na avdiovizualne storitve ter v manjši meri na internet. Zakonodaja EU je vodila k poenoteni zakonodaji varstva otrok v državah članicah, kljub temu pa med državami še obstajajo razlike, saj nekatere urejajo varstvo strožje oziroma natančneje, ostale pa so sprejele minimalne zahteve Evropske Unije. V Zvezni Republiki Nemčiji je medijsko pravo razvita pravna disciplina, ki prav tako obsega podrobno ureditev varstva mladoletnih oseb pred neprimernimi medijskimi vsebinami. Že sama nemška Ustava (Grundgesetz) postavlja izrecne temelje tega varstva, ko omenja omejitev informacijske in medijske svobode v prid varstva otrok in mladostnikov. Na zakonski ravni najdemo v nemškem pravnem prostoru dva specializirana zakona in sicer Zakon o varstvu mladoletnih oseb (Jugendschutzgesetz), ki vsebuje tudi določbe o varstvu mladoletnikov, ki niso v povezavi z medijskim pravom, ter Meddeželna pogodba o varstvu mladoletnih oseb v medijskem pravu (Jugendmedienschutz-Staatsvertrag). Prvi akt se osredotoča predvsem na medije na nosilcih ter filme v kinematografih, drugi pravni akt pa ureja vsebino na televiziji in internetu. V Republiki Sloveniji prav tako najdemo pravno podlago zakonskega varstva otrok pred škodljivimi medijskimi vsebinami v Ustavi Republike Slovenije, ki pa sicer ne omenja tega varstva izrecno. Na zakonski ravni so otroci varovani s posameznimi določbami. Tako najdemo določbo, ki določa varstvo otrok v povezavi s tiskanimi mediji, v Zakonu o medijih, varstvo pred vsebinami na televiziji pa določa Zakon o avdiovizualnih medijskih storitvah.

Title:Protection of minors in media law
Abstract:In media law, protection of minors means protecting children from the media content which harms or may harm their physical, moral, or psychological development. With fast and never-ending progress of technology, it is impossible to avoid the media. However, not all media content is appropriate for children and minors to see, hear, or read as they are extremely perceptive for the messages the media is transmitting. Legal basis for protection of minors in media law can already be found at international level in human rights treaties, allowing restrictions to freedom of expression in order to protect other values and morals (in this case minors). European Union enforced particular rules, most of which regulate audio-visual services, leaving some to deal with the internet. In this field, regulated by the EU, legislation has been harmonized in most Member States; nevertheless, differences in regulations still exist. Media law in Federal Republic of Germany is very well developed and includes detailed regulation of minor’s protection. Legal basis can be found in the German Constitution (Grundgesetz), where freedom of information and media is restricted for the protection of minors in connection to media law. There are two laws in Germany that specifically focus on this matter. The first is the Protection of Young Persons Act (Jugendschutzgesetz), which also regulates other aspects of protection of minors, such as legal age for alcohol and tobacco purchase and consumption. The second legal act is the Interstate Treaty on the Protection of Human Dignity and the Protection of Minors in Broadcasting and in Telemedia (Jugendmedienschutz-Staatsvertrag). The latter stipulates broadcasting and internet media content, while the Protection of Young Persons Act is more focused on Data media and movie performances/films. The legal foundation for protection of minors in media law in the Republic of Slovenia is also found in its Constitution (Ustava Republike Slovenije). Children are protected with different provisions from various acts. Protection of minors in connection to print media is found in Media Act (Zakon o medijih), while the protection of minors before broadcasted media content is regulated in Audio-visual media services Act (Zakon o avdiovizuanih medijskih storitvah).
