Title:OPRAVILNA SPOSOBNOST IN SKRBNIŠTVO DEMENTNEGA PACIENTA

Abstract:IZVLEČEK Prebivalstvo v Sloveniji se stara. Starostniki so ena od skupin prebivalstva, ki potrebujejo poglobljeno obravnavo, saj so zaradi svojih bioloških lastnosti in spremenjenih pogojev življenja zdravstveno in socialno ogroženi. S staranjem pa je povečana tudi obolevnost in povečano število kronično napredujočih bolezni, med katere uvrščamo tudi demenco. Za posledicami te bolezni trpi kar četrtina Slovencev, starih nad 65let. Starostniki so skupina ljudi, ki so ogroženi oziroma na nek način ranljivi in potrebujejo pravno zaščito in povečano skrb preko različnih institucij in oblik pravne zaščite. Ena izmed njih je skrbništvo, ki je predstavljeno v tem magistrskem delu. Raziskovalna metodologija. V raziskavi je bila uporabljena kvantitativna metodologija. V raziskovalni vzorec je bilo vključenih 97 stanovalcev Trubarjevega doma Loka, 133 stanovalcev Doma starejših Laško in 270 stanovalcev CSD Laško, ki jim je bil določen skrbnik za poseben primer ali pa odvzeta poslovna oziroma opravilna sposobnost. Rezultati. Rezultati raziskave kažejo, da je tudi v občini Laško upoštevana ena izmed temeljnih pravic človeka in je manj kot 5 odstotkom dementnih pacientov odvzeta opravilna sposobnost. Prav tako so rezultati pokazali, da živi občini Laško 2.370, ki so starejši od 65 let, od tega jih ima 270 demenco. Po spolu glede na diagnozo demenca, prevladujejo ženske. Sklep. Vsak človek je osebnost zase in vsem so z rojstvom dane oziroma prirojene določene pravice, na družbi in državi pa je, da te pravice spoštuje in uresničuje. Pomembno je tudi, da te temeljne pravice lahko upoštevamo in uresničujemo ter spoštujemo človeka z vsem dostojanstvom do konca njegovega življenja le pod pogojem, da smo z njimi seznanjeni.

Title:Capacity to contract and the determination of guardianship of demented patient
Abstract:ABSTRACT The population in Slovenia is aging. The elderly are one of the groups of people that needs a thorough and special treatment for they are medically and socially endangered due to their specific biological nature and the changed conditions of living. The consequences of aging are also the increase of falling ill and the increased number of chronically progressive diseases, such as dementia. As much as one quarter of Slovene population suffers from the consequences of this serious mental disorder. These people are endangered and in some respect also vulnerable and they, therefore, need legal protection and a more thorough care provided for them by different institutions and different forms of legal protection. One of them is custody which is presented in this thesis. Research methodology. The quantitative methodology has been used in this thesis. The research sample has included 97 elderly residents from Trubarjev dom Laško, 133 elderly residents from Dom starejših Laško and 270 elderly residents from CSD Laško, who either have an appointed guardian for special cases or whom the capacity to exercise rights has been taken away. The findings of the research. The research has produced the following findings: In the Laško Commune one of the basic human rights is respected and less than 5 per cent of patients suffering from dementia have been deprived of their capacity to exercise rights. Conclusion. Every person is an individual personality and we are all given certain rights at birth. The state and the society should respect these rights and see to it that they be exercised under constitution. It is important to be aware of our basic human rights because only then we can respect and exercise them. The awareness is also the basis to respect the human being with all their dignity till the end of their lives.
