Title:OBVEZNOSTI PREVOZNIKA PRI NAKLADANJU IN RAZKLADANJU TOVORA

Abstract:Pri prevozu tovora po cesti, se prevozniki vsakodnevno srečujejo z različnimi ovirami, v svoji že ustaljeni prevozniški praksi. V diplomskem delu sem pozornost posvetil obveznostim prevoznika, na katere mora biti pozoren pri nakladanju in razkladanju tovora. Kot specialist na transportnem področju, redko pozna relevantne predpise in tako prihaja do razkoraka med običajno prakso prevoznikov in predpisi. Izpolnitev obveznosti prevoznika pri nakladanju tovora v veliki meri pripomore k uspešni in varni izvedbi prevoza. Na drugi strani pa upoštevanje obveznosti pri razkladanju, pomeni uspešen konec prevoza in s tem izpolnitev pogodbenih obveznosti. Vzporedno pa pri teh dveh operacijah izpostavljam problematiko odgovornosti prevoznikov za njihove voznike in izpolnitvene pomočnike. Pomembno je namreč, da prevozniki, kljub temu, da sami niso fizično prisotni pri izvedbi naklada, prevoza in razklada, vseeno odškodninsko odgovarjajo za dejanja svojih delavcev in izpolnitvenih pomočnikov. Omenjena pa je tudi problematika prevoznika pri izročitvi tovora, kadar pride do tako imenovanih ovir pri izročitvi.

Title:OBLIGATIONS OF ROAD CARRIER BY LOADING AND UNLOADING OF GOODS
Abstract:Although transportation is their common business, road carriers are faced with several problems by transportation of goods on daily bases. In the following work I write about obligations of road carrier that should be followed by loading and unloading of goods. Road carries are specialized for transport business, but they are rarely well known with relevant legislation, this causes large gap between legislation and practice. Key to provide successful and safe transportation is fulfilling all obligations by loading of goods. On the other hand, following obligations by unloading of goods, means effective end of transport service and completion of all contractual obligations. Parallel to operations of loading and unloading I am writing about responsibility of road carrier for his employees and other persons whose services he uses for performance of carriage. It is important for road carriers to realize, although they are not present by loading or unloading of goods, that they are responsible for omissions and damages caused by their employees and persons whose services they use. I also stress out problems of road carriers, when they are not able to deliver goods after their arrival at the place designated for delivery.
