Title:OBRNJENA SOLANGE DOKTRINA KOT ODRAZ DINAMIČNEGA RAZVOJA PRAVA EU

Abstract:Z ozirom na stopnjo integracije, ki jo EU dosega, natančneje na dejstvo, da EU ni več zgolj oblika ekonomske povezave med državami članicami, ampak da je ta tvorba že prerasla v politično unijo, ki priznava širok spekter človekovih pravic (mislim zlasti na novosti, ki jih je vpeljala Lizbonska pogodba – podelitev enake zavezujoče narave Listini o temeljnih pravicah, kot jo imajo primarni pravni akti EU in podelitev pravne osebnosti Uniji, ki je tako lahko pristopila k Svetu Evrope in postala podpisnica Evropske konvencije o človekovih pravicah in temeljnih svoboščinah, ki jo zavezuje), se v teoriji zastavlja vprašanje, ali se je EU razvila že tako daleč, da bi se lahko preko instituta evropskega državljanstva uvedlo varstvo temeljnih pravic na ravni prava EU. V želji po iskanju čim bolj praktičnih in učinkovitih pravnih rešitev so teoretiki zasnovali inovativen predlog obrnjene Solange doktrine, v izvirniku poimenovane »Reverse Solange«, ki že dobiva svoje prve zagovornike in nasprotnike. Za svoje izhodišče jemljejo »bistvo« državljanstva EU, kot je bilo opredeljeno v sodbi Sodišča EU v zadevi Ruiz Zambrano, in sicer z razlago člena 20 Pogodbe o delovanju Evropske unije in ob tem zagovarjajo, da lahko takšna razlaga Sodišča služi kot povezava med institutom državljanstva EU in konceptom varstva temeljnih pravic – namreč tudi v povsem notranjih situacijah »bistvo« državljanstva EU preprečuje kršitve temeljnih pravic. V tej nalogi zato, ob upoštevanju ustrezne sodne prakse, preučujem izvor doslej zadovoljivo uveljavljenega pravila Solange, ki predstavlja izjemo od načela primarnosti prava EU. Z ozirom na novejše razvojne tendence EU pa v nadaljevanju predstavljam zamisel o obrnjenem Solange pravilu, kako naj bi se le-to oblikovalo in funkcioniralo v praksi, prikazujem argumente, ki so mu v prid in jih soočam s protiargumenti oziroma ugotavljam, ali morda ostaja doslej uveljavljena izjema od načela primarnosti še naprej utemeljena.

Title:REVERSE SOLANGE DOCTRINE AS A REFLECTION OF THE DYNAMIC DEVELOPMENT OF EU LAW
Abstract:Considering the level of integration achieved by the EU, more specifically the fact that the EU is not just a form of economic link between the Member States anymore, but that this formation has grown into a political union, which recognizes a wide range of human rights (especially the novelties, which were introduced by the Lisbon Treaty - the same binding nature of the Charter of Fundamental Rights, as the primary EU acts have and granting legal personality to the Union, which then joined the Council of Europe and became a party of the European Convention on Human Rights and Fundamental Freedoms and bound by it), the question in theory arises, if the EU has already developed so far that it could be via the institute of European citizenship possible to introduce the protection of fundamental rights at the level of EU law. In search of the most practical and effective legal solutions, theorists devised an innovative proposal, the inverted Solange doctrine, originally named »Reverse Solange«, which already receives its first supporters and opponents. They take as their starting point the »substance« of Union citizenship, as it was defined in the Court’s judgment in case Ruiz Zambrano, by interpreting Article 20 of the Treaty on the Functioning of the European Union, and defend the fact, that such an interpretation of the Court could serve as the link between the institute of Union citizenship and the concept of protection of fundamental rights - even in purely internal situations the »substance« of Union citizenship precludes violations of fundamental rights. Having regard to the relevant case law, this study therefore examines the source of so far well established Solange rule, which means an exception of the principle of primacy of the EU law and then, with respect of the recent development tendencies of the EU, presents an idea of the inverted Solange rule, how it could be formed and function in practice, shows the arguments pro et contra, or said in other words, tries to find out, if the established exception to the principle of primacy stays still justified.
