Title:Postopki policije v luči Varuha človekovih pravic : diplomsko delo visokošolskega strokovnega študija Varnost in policijsko delo

Abstract:V diplomskem delu smo preučevali delo policije, predvsem pa, ali varuh človekovih pravic namenja dovolj pozornosti postopkom policije z vidika kršitev človekovih pravic. V uvodnih poglavjih predstavljamo človekove pravice, ki so temeljni del vsake ustavne države, saj oblikujejo razmerja med posameznikom in državo, poseganja v njihove pravice pa morajo biti omejene. Prav v pravice pa lahko posegajo naši represivni organi, kot je policija, ki smo jo v nadaljevanju poglavij podrobneje predstavili. Predstavili smo predvsem organizacijo ter pooblastila policije, uporabo katerih pa oblast dovoljuje le takrat, kadar je (pri)sila neizogibno potrebna pri preprečevanju nevarnosti za življenje, osebno varnost in premoženje ljudi. V nadaljevanem delu naloge namenjamo veliko pozornost varuhu človekovih pravic, saj je njegov položaj vsekakor pomemben dejavnik ustavnega varstva osebne svobode in drugih človekovih pravic. Na podlagi primerjave poročil varuha med leti 2003 – 2011 skušamo ugotoviti, ali število pobud varuha iz leta v leto narašča. V nalogi smo ugotovili, da varuh človekovih pravic namenja veliko pozornosti postopkom policije z vidika kršitev človekovih pravic, predvsem pa, da se morajo policisti v okviru izobraževanja in usposabljanja usposobiti za boljšo prepoznavo dejanskih okoliščin kršitev ter za boljše prepoznavanje pooblastil.

Title:POLICE WORK IN THE LIGHT OF THE OMBUSMAN
Abstract:In this diploma paper we studied the work of police, especially whether the Ombudsman devotes enough attention to police procedures with regard to human rights violation. In the introductory chapters we presented human rights, which are a basic part of every constitutional state, since they form relationships between the individual and the state and their violation must be limited. These rights can be violated by our repressive organs such as the police, which we later presented in more detail. We focused on the organization and the authorization of the police, which is fully allowed to be used only when repression is inevitable for saving life in danger, preserving personal safety and wealth. Further on we turned our attention to the Ombudsman, since the position largely contributes to constitutional protection of personal freedom and other human rights. On the basis of annual reports of the Ombudsman between the years 2003 and 2011 we tried to establish whether the number of Ombudsman’s initiatives gradually increased. We came to the conclusion that the Ombudsman devotes a great part of his attention to police procedures with regard to human rights and what is more, that during their training policemen must be taught to better recognize actual violation conditions and their authorizations.
