Abstract:Kariera javnih uslužbencev v državnih organih, kot je predstavljena v magistrski nalogi opredeljuje Zakon o javnih uslužbencih (ZJU) in Zakon o sistemu plač v javnem sektorju (ZSPJS). Kariera javnega uslužbenca se prične s sklenitvijo pogodbe o zaposlitvi po predhodno izvedenem javnem natečaju za zaposlitev na uradniškem delovnem mestu in postopku za zaposlitev na strokovno-tehničnem delovnem mestu. Zaposlovanje v upravnih službah je mogoče samo na temelju javnega natečaja, kjer je treba upoštevati načelo enakopravne dostopnosti delovnih mest za vse zainteresirane kandidate pod enakimi pogoji in zagotoviti izbiro kandidatu, ki je najbolje strokovno usposobljen za opravljanje nalog na delovnem mestu. V zvezi s tem se zastavlja vprašanje, ali se pri zaposlovanju javnih uslužbencev zagotavlja objektivna izbira kandidatov ali pa je izbira kandidatov v postopku javnega natečaja kljub zakonskemu določilu, da se izbere najbolj strokovno usposobljen kandidat, lahko subjektivna. Karierni sistem je urejen hierarhično, zato uradnik prične kariero v najnižjem nazivu delovnega mesta, nato pa postopno napreduje do višjih nazivov in višjih delovnih mest. Kariera javnega uslužbenca se odraža v napredovanju, bodisi na istem delovnem mestu ali s premestitvijo na zahtevnejše delovno mesto. Za napredovanje v višji plačni razred in v višji naziv na istem delovnem mestu je pomembna letna ocena delovne uspešnosti. Javni uslužbenec je lahko nagrajen tudi z delom plače za redno delovno uspešnost in z dodatkom k plači zaradi dodatnih delovnih obremenitev v okviru rednega delovnega časa, ter z drugimi nedenarnimi nagradami. Vsi navedeni elementi naj bi javne uslužbence spodbujali k večji učinkovitosti in uspešnosti opravljenega dela. Vendar je avtonomija delodajalca in predstojnika pri priznanju pravic javnim uslužbencem omejena zaradi porabe javnih sredstev z določilom tretjega odstavka 16. člena in drugega odstavka 92. člena ZJU, pa tudi predpisi s področja financ, zato delodajalec ne sme sprejeti odločitve, ki bi javnemu uslužbencu določale večji oseb pravic, kot je to določeno v zakonu, podzakonskih predpisih ali s kolektivno pogodbo, če bi s tem obremenil javna sredstva. Tudi v nemškem uslužbenskem sistemu zakonodaja določa karierni sistem le za uradniška delovna mesta.

Title:CAREER OF CIVIL SERVANTS IN GOVERNMENT AGENCIES
Abstract:Career of civil servants in government agencies, as presented in the thesis, is identified in the Civil Servants Act (ZJU) and Public Sector Salary System Act (ZSPJS). Career of a civil servant starts with the conclusion of the employment contract following an open competition for the job in the official workplace and following a recruitment procedure for employment in the professional-technical workplace. Employment in administrative services is possible only on the basis of an open competition, where the principle of equal access to jobs must be respected for all interested candidates under the same conditions, and the selection of the candidate who is best qualified to perform the tasks in the workplace must be ensured. In this context, the question arises whether the employment of civil servants provides an objective choice of candidates; or the selection of candidates in the open competition, despite a statutory clause, in order to choose the most qualified candidate, can be subjective. The career system is organized hierarchically, thus an officer begins his career in the lowest job title, and then gradually progresses to higher titles and higher jobs. Career of a civil servant is reflected in the promotion, either in the same workplace or by transfer to a more demanding job. For promotion to a higher salary grade and higher title in the same workplace an annual assessment of performance is umportant. A civil servant may be rewarded with a part of a wage for regular work performance and with the supplement to the salary due to the additional workload within regular working hours, and with other non-cash prizes. All these elements should encourage civil cervants to increase the efficiency and effectiveness of the work. However, the autonomy of the employer and the head is limited in recognizing the rights of civil servants due to the use of public funds as stated in the provision of the third paragraph of Article 16 and second paragraph of Article 92 of ZJU, as well as regulations on finance; therefore the employer cannot make a decision which would grant to a civil servant a wider range of rights than set out in the Act, regulations or in the collective agreement, if that would mean burdening public funds. Even in the German system of civil servants the law provides a career system only for civil sevant jobs.
