Abstract:Že od razvoja človeštva je človek podvržen migracijam, bodisi iz radovednosti, želje po spremembi in spoznanju “drugega sveta”, bodisi iz potrebe po preživetju in boljšem ekonomskem položaju. Kljub temu, da se o delu v tujini veliko govori in piše, pa se presenetljivo majhen odstotek ljudi dejansko odloči za ta korak. Pogosto predstavlja oviro tuj jezik ter strah pred novitetami, novim okoljem in izgubo prijateljev ter sorodnikov. V moji diplomski nalogi bom predstavila kako je postopno prišlo do svoboščin notranjega trga. Svoboda gibanja oseb je poleg prostega pretoka blaga, storitev in kapitala tudi ena temeljnih svoboščin notranjega trga. Menim, da je ekonomska liberalizacija v nasprotju s protekcionizmom dobra, saj z vzpostavitvijo notranjega trga Evropske unije (v nadaljevanju EU), sodelovanjem in odprtostjo držav članic pridobimo večjo ponudbo na trgu in posledično zaradi konkurence tudi nižje cene ter višjo kakovost izdelkov. V drugem delu, ko bom prešla v tako imenovano jedro diplomske naloge, pa bom predstavila institut prostega pretoka oseb oz. natančneje delavcev ter “parazitske pravice” članov njihovih družin. V EU je prepovedana tako neposredna kot posredna diskriminacija na podlagi državljanstva, s prepovedjo pa je omogočeno, da državljani katerekoli države članice EU delajo v katerikoli članici po enakimi pogoji kot domači delavci. Zaradi mojega osebnega zanimanja glede odhoda v tujino, pa se bom dotaknila tudi vprašanja priznavanja poklicnih kvalifikacij, posebej teme vzajemnega priznavanja poklicnih kvalifikacij za poklic pravnika. Na koncu diplomske naloge bo predstavljen institut evropskega državljanstva, ki je temelj pripadnosti EU ter vse manjše pravice državljanov tretjih držav, ki so sorazmerne s potrebo po delovni sili.

Title:FREE MOVEMENT OF PERSONS IN THE EUROPEAN COMMUNITY
Abstract:Since the beginning of the evolution of mankind, men are subjected to migrations because of different reasons – either out of curiosity, wish for changes in their lives, exploring “the new world” or because of the need for survival and better economic situation. We can hear and read about working abroad daily, but there is surprisingly small percentage of people who actually decide to make this step. The main reason why people do not decide to go abroad are usually the lack of knowledge of foreign languages, fear of novelties, the new environment and sometimes even fear of losing contact with friends and relatives. In my diploma paper I will present how the freedom of the internal market was gradually achieved over a long period of time. Free movement of persons is one of the fundamental freedoms of the internal market besides free movement of goods, services and capital. I believe that the economic liberalization as opposed to protectionism is good, because by establishment of the EU internal market, cooperation and openness of the Member States, we get better offer on the market and because of the competition also lower prices and products of higher quality because of competition. In the second part of the diploma paper I will present the institution of free movement of persons, especially workers and the “parasitic rights" of their families. In the European Union direct and indirect discrimination based on nationality is forbidden and that is why citizens of any EU member can work in any state, under the same conditions as national workers. Because of my personal interest to move abroad I will also look into the theme of recognition of professional qualifications, especially for the profession of lawyer. At the end of the diploma paper I will present European citizenship, foundation belonging to the European Union and increasingly lower rights of third countries citizens which are proportionate to the need for labor force.
