Title:UPRAVNA IN CIVILNA ODGOVORNOST DRŽAVE ZA UPRAVLJANJE Z VODAMI GLEDE POPLAVNE ŠKODE

Abstract:Problematika poplav in poplavne škode kot posledice v zadnjih letih pridobiva na aktualnosti z vedno pogostejšim pojavljanjem poplavnih dogodkov, pri čemer je tudi njihov škodni potencial zmeraj večji. Kot je bilo ugotovljeno že v marsikateri državi, protipoplavni nasipi in podobni ukrepi ne zadostujejo za odvrnitev ali znatno zmanjšanje škodne posledice. K problematiki je potrebno pristopiti proaktivno in preučiti širša območja vodnih teles z različnih vidikov, pri čemer je gotovo najpomembnejše vzdrževanje samih vodnih teles in vodnogospodarskih objektov in smotrnejše prostorsko načrtovanje, ki bo predvidelo ključna mesta škodnih dogodkov in potencial njihove variacije. Naštete naloge so v Sloveniji zaupane načeloma izključno upravnim organom, organom lokalne skupnosti in drugim osebam javnega prava. Iz tega razloga se je nujno potrebno lotiti obravnavanja predmetne problematike z vidika upravnih odgovornosti, ki jih ima država v izvedbeni ali nadzorstveni obliki. Šele ko lahko zaobjamemo ključne upravne naloge, ki najbolj prispevajo k nastanku oziroma odvrnitvi poplavne škode, si lahko zastavimo vprašanje, ali in v kakšni meri je država lahko odškodninsko odgovorna za opustitev nalog, ki so ji bile zaupane s strani zakonodajalca, kako bi lahko primerno in pravočasno ukrepanje zmanjšalo ali v celoti preprečilo škodne posledice et.al. Zaradi praktično neobstoječe strokovne literature in pravne prakse na področju odškodninske odgovornosti države za upravljanje z vodami glede poplavne škode je obravnavanje predmetne tematike hkrati oteženo, a ravno zaradi tega in zaradi aktualne narave izjemno zanimivo.

Title:ADMINISTRATIVE AND CIVIL LIABILITY OF THE STATE REGARDING WATER MANAGEMENT IN RELATION TO FLOOD DAMAGE
Abstract:The issue of flooding and flood damage as its result is becoming a current issue because of increased occurrences of flood events in recent years, and the damage potential is also becoming increasingly greater. As has already been determined in many countries, flood embankments and similar measures are not sufficient to deter or substantially reduce the outstanding consequences. The problem has to be approached proactively and to consider the wider area of water bodies from different angles; certainly the most important is the maintenance of the water bodies themselves and water facilities, but also more systematic economic planning, which will anticipate the key places of flood damage and its potential variation. Tasks listed are in Slovenia in principle entrusted exclusively to administrative bodies, local authorities and other public entities. For this reason, it is necessary to address these issues in terms of the administrative responsibilities of the state in implementation or in supervisory form of action. Only once we have comprised all the key administrative tasks that contribute most to the occurrence or prevention of flood damage, you can ask the question of whether and to what extent the state can be liable for the failure of the tasks entrusted to it by the legislature, how appropriate and timely action could reduce or completely avoid the consequences, etc. because there is virtually no literature and case-law in the field of state liability for water management in regard to flood damage discussing this topic is difficult, but at the same time precisely because of this and because of the current relevance it is extremely interesting.
