Title:Organizacijski model obravnavanja pritožb zoper policijo : diplomsko delo visokošolskega strokovnega študija Varnost in policijsko delo

Abstract:Diplomsko delo obravnava organizacijski vidik pritožbenega postopka nad delom policije, tako po obliki kot po vsebini. Pri obravnavi oblik oziroma modelov pritožbenega postopka nas je zanimala vključenost civilnega ali državljanskega nadzora v sam postopek. Medtem ko smo bili pri obravnavi vsebine pritožbenega postopka predvsem pozorni na njegovo procesno ureditev, pravna pravila in načela. Delo je razdeljeno v teoretično-raziskovalni del, v katerem najprej opišemo zgodovinski razvoj pritožbenega postopka v slovenski policiji. V nadaljevanju pa opišemo vse pojavne oblike pritožbenih modelov, od njegovih zgodnjih oblik, urejenih po modelu notranje policijske preiskave, pa vse do zadnjih aktualnih ureditev, v katerih je sprejem, preiskava in odločitev o utemeljenosti pritožbe v izključni odgovornosti zunanjega pritožbenega telesa in ne-policijskega osebja. Kot zanimivost navajamo, da se še vsi modeli pritožbenih postopkov, v večji ali manjši meri, uporabljajo v večini držav. V teoretičnem delu naloge opisujemo tudi teoretično zasnovo učinkovitega pritožbenega postopka, cilje, ki naj bi jih zasledoval, in temeljna načela, po katerih naj bi bil urejen. V zadnjem delu naloge teoretične ugotovitve primerjamo z aktualno ureditvijo pritožbenega postopka v Zakonu o nalogah in pooblastilih policije iz leta 2013, ter potrdimo tezo, da je ta urejen po primerljivih mednarodnih modelih pritožbenih postopkov. Prav tako potrdimo tezo, da procesna ureditev aktualnega pritožbenega postopka v veliki meri sledi teoretičnim izzivom učinkovitega pritožbenega postopka, pri čemer smo naleteli na manjše zadržke, ki smo jih tudi ustrezno opisali. Kot zadnje v nalogi opišemo in izpostavimo temeljna načela pritožbenega postopka, za katera ugotovimo, da v Zakonu o nalogah in pooblastilih policije iz leta 2013 niso zadostno pravno urejena.

Abstract:Thesis deals with the organizational aspect of dealing with citizen complaints against police in both way, form and content. While we were researching different forms or models of complaints procedure, we were interested in the involvement of civilian personnel or civilian oversight in the process itself. And while we were reading the contents of the process, our attentive were to its procedural and legal rules and fundamental principles. The work is divided into a theoretical part of the research, where we describe historical overview and development of the procedure in the Slovenian police. Later on we describe all the models of the complaints procedure which we found, like models from its early forms, organized on the base of the internal police investigation and all the way to the last current models, in which the adoption of an investigation and a decision on the merits of the complaints is in the sole responsibility of the external civilian oversight bodies and non-police personnel. Interesting note is, that we can find all the models of the complaints proceedings still operational in most countries. Thesis also describes the theoretical design of an effective complaints procedure, the objectives to be pursued and the fundamental principles by which to be managed. In the last part of the thesis we compare theoretical findings with the current legislation of the complaints procedure in the Law on the functions and powers of the police from 2013. We confirmed the theory, that current complaints procedure is arranged by comparable international models of the civilian oversight. We also confirmed the theory, that the current procedural arrangements largely follows the theoretical challenge of effective complaints procedure. We have encountered some reservations, which we properly described. Finally, we describe and expose the fundamental principles of the complaints procedure, which stated that are not adequately regulated by the Law on the functions and powers of the police.
