Abstract:Diplomsko delo preučuje temeljne zahteve za registracijo znamke s poudarkom na barvnih znamkah: ali barva predstavlja znak, jo je mogoče grafično prikazati in če je sposobna razlikovati blago ali storitve enega podjetja od blaga ali storitev drugega podjetja. Avtorica na podlagi analize primerov iz prakse Sodišča EU in OHIM opozarja na težave, ki se pojavljajo pri registraciji barve kot znamke. Kljub temu da so temeljne zahteve enake za vse prijavitelje, je potrebno registracijo barve presojati od primera do primera. Avtorica prav tako opozori, da obstaja še precejšnja negotovost glede obsega varstva barv kot znamk, iz česar izhaja, da ni odveč previdnost, saj je barvna znamka novejši pojav in morebitna nova sodna praksa lahko zavzame drugačna stališča od obstoječe.

Title:REGISTRATION OF COLOUR TRADE MARKS
Abstract:The purpose of the thesis is to examine the basic requirements for registering a colour as a trade mark. There are three criteria that a mark must meet: the mark must be a sign, the mark must be capable of being represented graphically and the mark must be capable of distinguishing the goods or services of one undertaking from those of other undertakings. Authoress analyses European Court of Justice case law and OHIM case law and on its basis notes the difficulties relating to registering colours as trade marks. Despite the fact that the basic requirements are the same for all applicants, it is necessary that colour registration is assessed case by case. She also points out that there is still considerable uncertainty regarding the scope of protection of colours as trade marks and because of this, some carefulness should still be applied since colour marks are a new phenomenon and additional case law can take another direction.
