Title:DEJANSKO URESNIČEVANJE BISTVENE VSEBINE PRAVIC DRŽAVLJANOV EU

Abstract:Novejša sodna praksa Sodišča EU uvaja nov pristop uporabe prava EU na področju prostega gibanja oseb in državljanstva Unije, z vpeljavo merila dejanskega uresničevanje bistvene vsebine pravic državljana Unije, ki so mu podeljene zaradi tega statusa in tako bistveno razširja obseg uporabe prava EU. Merilo namreč implicira, da v izjemnih primerih, če pride do preprečitve dejanskega izvrševanja bistvene vsebine pravic v zvezi s statusom državljanstva Unije ali otežitve uresničevanja teh pravic, tudi položaj, ki ne vsebuje čezmejnega elementa, spada na področje uporabe prava EU. Posledice novega pristopa se bodo odražale v migracijski politiki držav članic. Na eni strani pravo Unije tako vedno bolj vpliva na pravila držav članic za pridobitev in odvzem državljanstva. Na drugi strani so države članice primorane podeliti pravice do prebivanja določenim kategorijam državljanov Unije in njihovim družinskim članom, ki pred tem niso imeli pravice se sklicevati na pravo Unije, kar bo imelo vpliv tudi na večje finančne obremenitve držav članic. Manj očitna, a zagotovo ne manj pomembna, je tudi posledica na varstvo temeljnih pravic EU, saj bi široka razlaga člena 20 PDEU namreč lahko sprožila uporabo temeljnih pravic, kljub temu pa za enkrat še ni mogoče z gotovostjo ugotoviti natančnega dometa novih načel oblikovanih s strani Sodišča EU.

Title:THE GENUINE ENJOYMENT OF THE SUBSTANCE OF CITIZENSHIP RIGHTS
Abstract:Recent case law of the Court of Justice of the European Union (CJEU) introduces a new approach to the scope of application of EU law in the areas of free movement of persons and Union citizenship, by applying the measure of genuine enjoyment of the substance of the rights conferred by virtue of their status as citizens of the Union. The criteria implies that in exceptional cases when an Union citizen runs the risk of being deprived of the genuine enjoyment of the substance of the rights conferred by virtue of the status as a citizen of the Union, no cross-border element is needed since the loss of the rights in itself constitutes a sufficient link to EU law. This in turn has significant consequences for the immigration laws of the Member States. On the one hand, Union law will increasingly influence the Member States' rules on acquisition and loss of nationality. On the other hand, the Member States will have to accord residence rights to certain categories of Union citizens and their family members who previously were not entitled to invoke Union law, which will result also in higher financial burdens for the Member States. Less obvious, but definitely not less relevant, is the potential impact of these cases on the protection of EU fundamental rights. The wider interpretation of article 20 TFEU could trigger the application of EU fundamental rights, although it is not yet possible to ascertain the precise scope of the principles articulated by the CJEU.
