Title:HALAKHAH - TEMELJI IN IZBRANE TEME JUDOVSKEGA DRUŽINSKEGA PRAVA

Abstract:Judje so uspeli obdržati svojo identiteto tisoče let, kar je svojevrsten fenomen, saj je pravo uspelo preživeti in se tudi razvijati ne glede na razpršenost in ločenost Judov po svetu. Judovsko pravo – halakhah je dano od Boga in je ipso facto zavezujoče. Diplomska naloga predstavi kaj halakhah pravzaprav je v vsej svoji razsežnosti. Kako se judovsko pravo razvijalo skozi zgodovino, katera področja zajema in kaj je vsebina le teh. Temelji na Torah, prvih petih knjigah Biblije, ki so bile dane ljudem Izraela na gori Sinaj, v judovski tradiciji imenovana pisana Torah. Zadnje štiri Mojzesove knjige vsebujejo pomembno zakonodajo, sistematično zastavljene politične in socialne institute kraljestva religioznih predstavnikov in svetega ljudstva, ki ga je Izrael moral vpeljati in prava, ki bi naj definiralo izbrano ljudstvo. To pa spremlja ustna Torah – Mishnah, Tosefta in Midrasheh Halakhah. Načeloma je bilo zapisovanje prava prepovedano, zato so pravo učili in prenašali do tannaičnega obdobja samo ustno. Vendar je potreba po ohranitvi judovskega pravnega sistema pretehtala in nato so tudi ustno pravo zapisali. Podrobneje obravnava tudi sekundarne pravne vire, najpomembnejši od teh je Talmud, saj predstavlja eno najstarejših, živečih, pravnih tradicij na svetu; po htonični od katere se je kasneje ločilo in druge pravne vire judovskega prava. Sproti pa kot dokazila, navaja verze posameznih knjig iz katerih je halakhična avtoriteta črpala zakonodajo, ki jo je na podlagi te naprej razvijala. Obravnava tudi izbrane teme judovskega družinskega življenja, saj je bila dejansko družina glavna gospodarska enota, ki je predstavljala okvir za izkoriščanje zemlje in ustvarjanjem dobička od nje. Na tem mestu obravnava še zaroko, poroko in ločitev v okviru halakhičnega prava ter v povezavi s tem tudi dedno pravo.

Title:HALAKHAH - PILARS AND CHOSEN TOPICS OF THE JEWISH FAMILY LAW
Abstract:Jews have managed to keep their identity for thousands of years, which is a unique phenomenon, since the law managed to survive and even develop regardless of the dispersion and separation of Jews around the world. Jewish Law - halakhah is given by God and it is ipso facto binding. The thesis presents what exactly halakhah is in all of its' dimensions. How has Jewish law developed through the history, what fields it covers and what are contents thereof. It is based on the Torah, the first five books of the Bible, that were given to the people of Israel on Mount Sinai, so called written Torah in the jewish tradition. Last Four Books of Moses contain important legislation, a systematic set of political and social institutes of kingdoms' religious representatives and holy people that Israel needed to initiate and contain the law that should define the »chosen people«. This is accompanied by oral Torah - Mishnah, Tosefta and Midrasheh Halakhah. In principle, it was forbidden to write the law, and therefore until tannaic period the law was thought and transmitted only orally. However, the need to preserve the Jewish legal system outweighed and then the oral law have been written down as well. The thesis presents the secondary legal sources, the most important of these is the Talmud - it is one of the oldest living, legal traditions in the world, after htonic, of which was later separated and other legal sources of Jewish law. As evidence, it is citing verses from various books in which halakhic authority drew legislation from and developing it further. It also deals with selected topics of Jewish family life, because the family was actually the main economic unit, representing the framework for the exploitation of the land and making a profit from it. At this point the thesis deals with the betrothal, marriage and divorce within halakhic law and in this context the law of succession.
