Title:THE LEGAL STATUS OF THE WORKER IN THE EVENT OF AN ACCIDENT AT WORK
Abstract:ABSTRACT Accident at work is any accident that happens during the work or related to work. There are many different causes sourcing out accident at work, but basically we can sort them on subjective and objective causes. Legalities, which determine accidents at work represents a unit of slovenian and international terms. Injuries are consequences of accident at work and may be mild, serious or even tragical. Prevention of accident is a moral and legal responsibility of the employer. Obligations of employer are determined by The Health and Safety at work Act, which is basic and special act. This act determines a number of employer's obligations, such like: risk assessment, training of workers, giving informations to workers, pre-care, health promotion at work, determining technical assistent, etc. Employer's obligations represent at the same time worker's rights, but a position of worker, in legalities, is not only determined with rights but also with obligations (respecting employer's obligations, using the protective equipment, medical examination, etc.). In case of injury at work a worker has a right to demand an appropriately damage. Before that, we have to found out, who is responsible for the accident, is it fully employers fault, by not taking measures, which determine acts for health and safety at work or did worker contributed to the accident, because his behaviour at work was negligant or he did not respect employer's instructions. The employer's liability can be culpable, which is a primary rule in Slovenian law, or objective. Generally a worker will have a right to demand a compensation for damage, which is an non-restitutional damage and represents only satisfaction and have no meaning of restitution or he will also have a right to demand a compensation for the restitutional damage.
