Title:Kazenskopravni vidiki zdravniške evtanazije : diplomsko delo visokošolskega strokovnega študija Varnost in policijsko delo

Abstract:V diplomski nalogi so opredeljene razlike med usmrtitvami s strani zdravnikov ter zdravniško evtanazijo. Odgovarjamo tudi na vprašanje, ali lahko pacient v skladu z veljavno slovensko zakonodajo veljavno privoli v to, da ga nekdo usmrti. V diplomski nalogi je opisan pojem evtanazije, predstavljena je njena zgodovina oziroma razvoj in razumevanje evtanazije vse od antičnih časov dalje. Predstavljene so tudi vrste evtanazije in njihov opis, razlika med posrednim in neposrednim ravnanjem ter paliativna nega. V nadaljevanju so navedeni argumenti za in proti legalizaciji evtanazije. V diplomski nalogi je opredeljen tudi medicinski vidik evtanazije. Opisana sta dva temeljna dokumenta s področja medicinskega vidika, to sta Kodeks medicinske deontologije Slovenije in Zakon o pacientovih pravicah. Predstavljen je tudi pravni vidik evtanazije po svetu na splošno ter ureditev evtanazije v slovenskem pravu. Opisane so sankcije v primeru, če zdravnik izvede evtanazijo v Sloveniji, saj kazensko pravo po slovenskem Kazenskem zakoniku, Kazenskem zakoniku 1 in Ustavi Republike Slovenije evtanazijo obravnava kot kaznivo dejanje uboja ali umora. Opisana je primerjalnopravna ureditev evtanazije, in sicer v treh državah, kjer je evtanazija dovoljena (Nizozemska, Belgija, Danska), predstavljeni pa so tudi medijsko najodmevnejši primeri evtanazije po svetu. V diplomski nalogi sta preverjeni dve hipotezi. V raziskovalnem delu so predstavljeni rezultati raziskave, katere namen je bil ugotoviti, kako dobro ljudje poznajo pojem evtanazija ter kakšno stališče imata zdravstveno osebje in laična javnost do evtanazije. Analiza raziskave je pokazala, da večina ljudi dobro pozna pojem evtanazije, medtem ko se stališče zdravstvenega osebja močno razlikuje od stališča laikov glede nje.

Abstract:This dissertation deals with the differences between executions by doctors and euthanasia. It also answers the question whether a patient can validly agree to be executed. The dissertation describes the term euthanasia as well as its history and the understanding of it which stretches back to the Greek Roman times. It presents different types of euthanasia and their descriptions, the difference between direct and indirect use and palliative care. Furthermore, it presents arguments in favour of euthanasia legalisation and its counter-arguments. The dissertation also defines the medical point of view of euthanasia with the description of two founding documents, namely, the Slovene Medical Codex of Deontology (Kodeks medicinske deontologije Slovenije) and the Patient Rights Act (Zakon o pacientovih pravicah). It also defines euthanasia from the legal point of view worldwide and the arrangement of it in Slovene law system. Sanctions that follow in cases where a doctor performs euthanasia in Slovenia are also presented (criminal law treats euthanasia as a homicide or manslaughter) which are taken from the Penal Code (Kazenski zakonik) and the Constitution of Slovenia (Ustava RS). In the dissertation, we can also observe the legal comparison of euthanasia, namely between the three countries where euthanasia is legally permitted (the Netherlands, Belgium and Denmark). It also presents cases of euthanasia from all over the world, which attracted a lot of media attention. There are two hypotheses examined in this dissertation. The research presents the results of a study, the purpose of which was to find out how well is the term “euthanasia” known among people, what is the standpoint of medical staff towards euthanasia and if there are any laymen connected to this particular subject. The analysis of the research has shown that the majority of people are well informed about the meaning of the term “euthanasia”; however, the standpoint of medical staff differs immensely from the standpoint of laymen.
