Title:Odprava posledic neupravičene obsodbe : diplomsko delo univerzitetnega študija

Abstract:Odprava posledic neupravičene obsodbe je urejena v 32. poglavju Zakona o kazenskem postopku (2013), [v nadaljevanju ZKP] in določa postopek za povrnitev škode, rehabilitacijo, ter uveljavitev drugih pravic oseb, ki so bile neupravičeno obsojene ali jim je bila neutemeljeno vzeta prostost. Neupravičeno obsojene osebe imajo po ZKP pravico do povrnitve škode, pravico do javne objave sporočila o novi odločbi, možnost izbrisa neupravičene obsodbe iz kazenske evidence, pravico do priznanja delovne oziroma zavarovalne dobe in pravico, da zahtevajo prepoved uporabe podatkov iz spisov, ki se nanašajo na neupravičeno obsodbo. Poleg zakonske ureditve je odprava posledic neupravičene obsodbe urejena tudi v 30. členu Ustave Republike Slovenije (2013), [v nadaljevanju Ustava RS]. Ustava RS v tem členu zaradi možnosti primerov krivih obsodb predvideva pravico do rehabilitacije in odškodnine. Pravico do rehabilitacije, do povrnitve škode in druge pravice po zakonu ima vsak, ki je bil po krivem obsojen za kaznivo dejanje ali mu je bila prostost neutemeljeno odvzeta. Zaradi svoje zgodovine Slovenija pozna tudi Zakon o popravi krivic (2007), ki je v razmerju do ZKP lex specialis in se uporablja samo za osebe, katerim je priznan status političnega zapornika. Ugotovili smo, da brez vzrokov, zaradi katerih je prišlo do neupravičene obsodbe, tudi posledic ne bi bilo. Zaradi tega je glavna naloga države, da sprejme reforme, ki bi take napake zmanjšale. Potrebna je tudi ustrezna ozaveščenost ljudi s problemom neupravičene obsodbe. V Sloveniji raziskav glede neupravičene obsodbe nismo zasledili, kar pomeni, da se temu problemu posveča premalo pozornosti.

Abstract:The consequences of unjustified conviction and their abolishment are arranged in 32nd chapter of Criminal Procedure Act, [hereinafter CPA] which defines damage repayment procedure, rehabilitation and enforcement of other rights for all the persons who have been wrongly convicted or have been unduly deprived of their liberty. According to CPA, wrongly convicted persons have a right to damage retribution, a right of new provision that concern them to be publicly announced, possibility of unduly conviction to be erased from their criminal record, a right for their working or insurance period to be acknowledged and finally, a right to claim a prohibition of data usage from the documents regarding an unjustified conviction. Beside the legal regulation the abolishment of consequences of unjustified conviction are also settled in 30th article of the Constitution of the Republic of Slovenia [hereinafter Constitution RS]. Due to the possibility of false convictions, the Constitution RS foresees a right to rehabilitation and compensation. Anyone, who has been wrongly convicted for a criminal offence or has been unduly deprived of his liberty, has according to the law, a right to rehabilitation, a right to compensation and other rights. Because of its history, Slovenia in addition to CPA knows Redressing of Injustices Act, which in relation to CPA is lex specialis and is used especially for the people who have been granted a status of political prisoner. We came to the conclusion that without reasons that caused unjustified conviction there would be no consequences. Therefore, the main task of the country is to adopt reforms that would reduce such errors. Moreover, an adequate public awareness to the problem of unjust conviction is much needed. The research on unjust conviction was not detected in Slovenia, which shows that too little attention is paying to this problem.
