Title:V VSEH PRAVNIH ZADEVAH ŠKOFIJE ZASTOPA ŠKOFIJO KRAJEVNI ŠKOF

Abstract:Diplomska naloga obravnava kanon 393 zakonika cerkvenega prava, ki je jedrnat vendar vsebinsko izredno obsežen. Kanon se glasi »Krajevni škof zastopa škofijo v vseh pravnih zadevah«. V osebi škofa je po cerkvenem pravu združena trojna oblast: zakonodajna, sodna in izvršna. Krajevni škofje so zakoniti nasledniki apostolov in so odgovorni za življenje krajevne Cerkve. Škof je vključen v škofovski zbor, ta pa je v soglasju s papežem nosilec vrhovne oblasti nad vso Cerkvijo. Škofija je pravna oseba tako po cerkvenem kot po civilnem pravu. To med drugim potrjuje Sporazum ki ureja pravna vprašanja med RS in svetim sedežem, ki ga je z zakonom potrdil parlament leta 2004. ZCP opredeljuje škofijo kot najbolj popolno obliko krajevne Cerkve. Gre za skupnost vernikov, ki so teritorialno povezani. Nad vsako škofijo ima krajevni škof lastno in neposredno oblast. V ZCP je krajevni škof opredeljen kot pastir vseh župnij v svoji župniji, ker pa svojega poslanstva zaradi obsega dela ne more opravljati osebno, ga opravlja preko župnikov ki so njegovi avtonomni sodelavci. Župnik dela pod škofovo oblastjo, z njim je v hierarhičnem odnosu in mu je za delo neposredno odgovoren. Škof je dolžan njegovo delo nadzirati in v primeru škodljivega ravnanja ali celo storitve kaznivega dejanja tudi učinkovito ukrepati. V zakonskih besedilih svetega sedeža se zavrača enačenje razmerja škof- župnik z odnosom delodajalec- delojemalec. Zato tudi škof in škofija zavračata odškodninsko odgovornost za kazniva dejanja ki jih stori župnik. Cerkvev razpolaga z mnogimi gmotnimi dobrinami, s temi pa v primeru škofije v skladu s predpisi ZCP razpolaga škof. Zaradi narave stvari dobrine škofije upravlja škofijski ekonom pod avtoriteto krajevnega škofa, to pa ga ne odvezuje odgovornosti v primeru zlorab. Škof je v svoji škofiji tudi zakonodajalec. Gre za eno izmed treh oblasti ki poleg sodne in izvršne tvorijo vodstveno oblast, ki je v škofiji zaupana škofu. V škofiji je na prvi stopnji sodnik škof, ki pa svojo sodno oblast opravlja preko sodnega vikarja.

Title:THE DIOCESAN BISHOP REPRESENTS HIS DIOCESE IN ALL ITS JURIDIC AFFAIRS
Abstract:This thesis addresses church/canno law, more specifically it addresses canon 393, which although concise is extraordinarily complex content wise. The canon reads: »The diocesan bishop represents his diocese in all its juridic affairs.« According to church/canon law, the bishop represents the three branches of government/authority, i.e. legislative, judicial and executive. The diocesan bishops are considered to be the heirs of the apostles and are responsible for life in the diocesan Church. The bishop is a member of the bishops’ council which with the consent of the Pope holds supreme power over the Church. Under both canon law and civil law the diocese holds legal personality. In Slovenia this matter is settled as part of the agreement between the Republic of Slovenia and the Holy See, which was ratified by the Slovenian parliament in 2004. Code of cannon law defines the diocese as the most appropriate form of local Church. It is a community of believers who are territorially connected. The bishop holds individual and direct power over each diocese. The CCL defines the local bishop as the pastor of all dioceses within his diocese, but the amount of work prevents him from attending to his mission directly and he is, therefore, supported by the priests who are his autonomous associates. The priest works under the auspices of the bishop, holds a hierarchical relation with the bishop and is directly responsible to him. The bishop is responsible for monitoring the work of the priest and is obliged to act appropriately in cases of harmful or criminal practice by the priest. The legal texts of the Holly Sea reject the analogy between the relation bishop-priest and employer-employee. Consequently, the diocesan bishop and the diocese reject any liability for the criminal act of the priest. The Church is the owner of a large amount of resources and goods, and in accordance with CCL, the diocesan bishop is directly responsible for these goods and resources. Although, the goods and resources of the diocese are managed by the diocesan treasurer under the authority of the local/diocesan bishop, he is personally liable in cases of misuse. Furthermore, the diocesan bishop is also the legislator. Along with the judicial and executive, it is one of the three branches that form the administrative authority of the diocesan bishop within the diocese. Within the diocese, the diocesan bishop is the first instance judicial authority but his authority is executed through the judicial vicar.
