Title:PRAVICA DO ZASEBNOSTI NA SOCIALNIH OMREŽJIH

Abstract:V pričujočem delu ugotavljam, da je pravica do zasebnosti, kljub odsotnosti univerzalne definicije, vsesplošno priznana. V slovenskem pravnem sistemu ima status tako človekove, kakor tudi osebnostne pravice, pri čemer je varstvo zasebnosti priznano na mednarodni, evropski ter ustavni ravni. Zaradi tehnološkega razvoja je pravica do zasebnosti podvržena nenehnemu spreminjanju, saj je naloga prava, da v svojem razvoju sledi dejanskemu stanju v družbi, zaradi česar se razsežnosti pravice do zasebnosti nenehno širijo. Zasebnost v socialnih omrežjih je predmet varstva komunikacijske in korespondenčne zasebnosti, prav tako pa so podatki uporabnikov predmet varovanja v okviru varstva osebnih podatkov. Pri proučevanju pravice do zasebnosti polnoletnih otrok nasproti staršem sem ugotovil, da je nemogoče postaviti splošno pravilo, ki bi določala meje dopustnosti posegov v pravico, saj se pri tehtanju med pravno priznanimi interesi posmeznikov pojavlja preveč spremeljivk, zaradi česar je potrebno dopustnost posegov presojati od primera do primera na podlagi t.i. načela tehtanja interesov.

Title:THE RIGHT TO PRIVACY IN SOCIAL NETWORKS
Abstract:In the thesis paper, it is concluded that the right to privacy is, in spite of the absence of a universal definition, universally recognized. Slovenian legal system recognises the right to privacy status of a human right, as well as a personal right. Protection of privacy is acknowledged on the international, European and constitutional level. The right to privacy is subjected to constant modification due to ongoing technological development, as it is in the nature of law itself to follow the changes that occur in the society. This is why the dimensions of the right to privacy are constantly expanding. Privacy in social networks is subjected to the protection of privacy of communication and correspondence, as well as the protection of data privacy. While studying the right to privacy of adult children against their parents, I came to the conclusion that it is impossible to determine an abstract legal rule that would define the boundaries between legally recognised interests of individuals in all possible situations, as there are too many variables to consider. The only abstract rule that can be set is to balance among interests case by case.
