Abstract:
V svojem diplomskem delu predstavljam Incotermse, njihov razvoj, pomen ter strukturo posameznih paritet klavzul, pri čemer se osredotočam predvsem na obveznosti in pravice pogodbenih strank iz mednarodne prodajne pogodbe. Prav tako bom opredelila osnovne značilnosti mednarodne prodajne pogodbe ter prevozne pogodbe. Zadnje poglavje diplomskega dela je opredeljeno s primerjavo Incoterms 2010 z mednarodno prodajno pogodbo ter s prevozno pogodbo. V teoretičnem delu diplomske naloge sem izpostavila bistvene značilnosti prevozne pogodbe. V tem delu sem opredelila dve pomembni mednarodni konvenciji, ki sta na področju transporta in mednarodne prodaje ključnega pomena za razumevanje pomembnosti prevozne pogodbe v povezavi s klavzulami ter samo prodajo blaga. Govorimo o mednarodni konvenciji za cestni prevoz blaga (CMR) ter o mednarodni konvenciji za železniški prevoz blaga (CIM).

Title:
The importance of Incoterms 2010 in international sales contract in connection with the contract of carriage
Abstract:
In my thesis I am presenting Incoterms, their development, the importance and structure of the different parities clauses, focusing primarily on the obligations and rights of the parties in international sales contracts. I will also define the basic characteristics of international sales contracts and the contract of carriage. The last chapter of the thesis is defined by comparing the Incoterms 2010 international sales contract and the contract of carriage. In the theoretical part of the thesis I highlighted the main features of the contract of carriage. In this section I have identified two important international conventions, which are related to transport and international sales is key to understanding the importance of the contract of carriage, in conjunction with the clauses and the sale of goods. We are talking about an international convention on the carriage of goods by road (CMR) and the International Convention for rail freight (CIM).
