Abstract:Področje trženja semenskega materiala je urejeno z uredbami in direktivami. Skozi primer C 59/11 in načela prava varstva okolja v diplomski nalogi analiziram zanimivejše segmente področja, njihov vpliv na kmetijski sektor ter posredno hrano ljudi in krmo živali. Združenje Kokopelli je nevladna organizacija, ki se ukvarja s trženjem semen starih sort zelenjadnic. Družba Graines Baumaux SAS je zoper združenje vložila tožbo zaradi nelojalne konkurence, ker je ugotovila, da 461 sort zelenjadnic v njihovi ponudbi ni sprejetih v skupne kataloge. Na prvi stopnji je francosko sodišče dosodilo odškodnino Graines Baumaux SAS. Kokopelli je zoper sodbo vložil pritožbo. Cour d’appel Nancy je prekinilo postopek in postavilo vprašanje za predhodno odločanje Sodišču Evropske unije. Vprašanje se je nanašalo na veljavnost direktiv o trženju zelenjadnic glede na to, da predpisujeta omejitve glede pridelave in trženja semena starih sort. V evropskem prostoru se goji vedno manj sort. Stare sorte izginjajo, medtem ko prevladujejo sorte, ki so komercialno zanimivejše. Omejitve pridelave in trženja starih sort na eni strani ter porast števila patentiranih sort, transgenih rastlin na drugi prispevajo k zmanjšanju biotske diverzitete ter posredno k potencialnemu pomanjkanju sort, prilagojenih posebnim razmeram, in omejevanju izbire potrošnika kmetijskih izdelkov na trgu.

Title:LEGAL ANALYSIS, CASE 59/11 (SEED SUPERVISION)
Abstract:The field of propagating material marketing is regulated with regulations and directives. Through the case C 59/11 and the principles of the environmental law the thesis analyzes the most interesting segments of the field, their impact on the agricultural sector and indirectly on the food for people and animal feed. The Association Kokopelli is a non-governmental organization, which is dealing with marketing of vegetables seeds of elder varieties. The company Graines Baumaux SAS filed a suit against the Association due to unfair competition, because it found out that 461 varieties of vegetables in the sortiment of Kokopelli where not accepted to the common catalogues. At the first instance the French court charged Kokopelli to pay damages to Graines Baumaux SAS. Kokopelli has filed an appeal against the judgment. Cour d’appel Nancy interrupted the procedure and asked the Court of the European Union a preliminary question. The question was about the validity of the directives on the marketing of vegetables seeds since they are setting limitations regarding the production and marketing of vegetables seeds of elder varieties. In Europe fewer and fewer varieties are being cultivated. Old varieties are vanishing, while varieties, which are commercially more interesting, prevail. The limitations of production and marketing of old varieties and the increase of the number of patented varieties, transgenic plants contribute to the decrease of biotic diversity and indirectly to the potential lack of varieties, adapted to special conditions, and limitation of the customer’s choice of agricultural products on the market.
