Abstract:Sprememba tožbe je institut civilnega procesnega prava, ki obsega dve podvrsti. To sta objektivna in subjektivna sprememba tožbe. Oba instituta sta uzakonjena v slovenskem pravu in sicer v Zakonu o pravdnem postopku. Podobno kot marsikateri zakon, tudi Zakon o pravdnem postopku v svojih določbah ne uporablja teoretičnih terminov objektivne in subjektivne spremembe tožbe. Oba instituta sta namreč obravnavana pod enotnim naslovom: Sprememba tožbe. Naslov obsega člene od 184. do vključno 187. člena. Pri tem 184. člen obravnava objektivno spremembo, čeprav uporablja zgolj splošen izraz - sprememba tožbe. 187. člen obravnava subjektivno spremembo tožbe, pri kateri tožeča stranka spremeni tožbo tako, da namesto prvotno tožene stranke toži nekoga drugega. Kot navaja zakon, pride do objektivne spremembe tožbe v primeru spremembe istovetnosti tožbenega zahtevka, če pride do povečanja obstoječega zahtevka ali uveljavljanje drugega zahtevka poleg obstoječega. Objektivne spremembe tožbe ne predstavljajo dogodki, ko tožeča stranka spremeni pravno podlago tožbenega zahtevka, zmanjša tožbeni zahtevek ali spremeni ali dopolni posamezne navedbe. Tožeča stranka lahko vse do konca glavne obravnave spremeni svojo tožbo tako, da toži namesto prvotne tožene stranke koga drugega. Ta dinamika predstavlja pojem subjektivne spremembe tožbe. Subjektivna sprememba tožbe je torej možna le na pasivni( toženi) strani in ne na aktivni( tožeči) strani. Do tovrstne spremembe bo v praksi prišlo v primeru, ko bo tožnik tekom pravdnega postopka ugotovil ali ocenil, da prvotni toženec ni pravi nosilec obveznosti, na katero se nanaša tožbeni zahtevek. Tožnik torej ugotovi, da se je zmotil glede tožene stranke, saj bi to morala biti neka druga fizična ali pravna oseba. Pogoj za uveljavitev instituta subjektivne spremembe tožbe je toženčevo soglasje. To je lahko podano izrecno ali konkludentno. Pri vsej materiji je pomembno dejstvo, da mora novi toženec pravdo prevzeti v obstoječem stanju. Omeniti velja tudi, da je subjektivna sprememba tožbe po svoji vsebini hkrati tudi umik tožbe proti prvotnemu tožencu.

Title:CHANGE OF LAWSUIT
Abstract:Change in action is the institution of civil procedural law, which comprises two sub-categories. These are the objective and subjective change in action. Both institutions are enshrined in Slovenian law, namely in the Civil Procedure Act, which, among its provisions does not refer to the theoretical terms “objective” and “subjective” changes in action. Both are dealt with under a single heading: change in action. The title encompasses Article 184 to Article 187 inclusive. Article 184 deals with objective change, although it is just using the generic term “change in action”. Article 187 speaks about subjective change, wherein the plaintiff amends his action so that instead of the original defendant he sues someone else. As the law states, an objective change in action occurs if the identity of the civil claim is changed, if an existing claim is increased, or enforcement of any other claim is added to the existing one. Objective change in action does not cover events where the plaintiff amends the legal basis of the claim, reduces the claim, or amends or supplements individual allegations. Plaintiffs may, however, change their lawsuit before the end of the trial to sue someone else instead of the original defendant. This is subjective change in action. Subjective change in action is therefore only possible on the passive side, that is, the defendant side, and not by the plaintiff, i.e. the active side. Such changes will in practice occur only in cases where the plaintiff, during the course of civil litigation, comes to believe that the original defendant is not the right holder of obligations to which the claim relates. The plaintiff therefore finds that he was mistaken about the defendant, as this would have to be another person, whether natural or legal. A precondition for the introduction of the institution of subjective change in action is the defendant's consent. It can be given either expressly or by implication. The important fact is that the new defendant has to become subject the litigation in the existing situation. It's worth noting that a subjective change in action is by its content also a withdrawal of the action against the original defendant.
