Abstract:Potrošništvo je osnovna premisa sodobnega ekonomskega sistema in vsak potrošnik je »esenca« preživetja obstoječe svetovne in tudi evropske ekonomije. Svet in Evropska unija sta se s sodobnim pojmom potrošnika kot ključnim deležnikom in poganjalcem ekonomije srečala v petdesetih letih prejšnjega stoletja, nekoliko kasneje, v sedemdesetih, pa se je intenzivno začelo govoriti in tudi formalizirati osnovne potrošnikove pravice, ki odtlej z osveščenostjo javnosti na moči le še pridobivajo. Ena izmed t. i. univerzalnih potrošnikovih pravic je tudi pravica do pravnega varstva. V predmetni diplomski nalogi govorimo o trenutno najsodobnejšem pristopu zaščite potrošnikov, in sicer o alternativnih metodah reševanja potrošniških sporov in novem trendu reševanja sporov preko spleta. Pri alternativnem reševanju sporov (ARS) gre za neformalne postopke reševanja sporov, v katerih stranke s pomočjo specializirane tretje osebe poizkušajo rešiti spor. Glavni prednosti ARS sta hitrost postopka in stroškovna dostopnost. Pristopi alternativnega reševanja sporov se nenehno razvijajo in ob revoluciji, ki jo je prinesel svetovni splet, se je začel v svetu razvijati tudi koncept reševanja sporov preko spleta. Tako pod kratico ODR (Online dispute resolution) razumemo mehanizme alternativnih načinov reševanja sporov z uporabo spleta. V slovenskem prostoru se uporablja kratica SRS – spletno reševanje sporov. Uporabi ARS in SRS postopkov se že od samega začetka kot najpomembnejša posledica pripisuje izboljšanje delovanja trga predvsem zaradi s tem predvidenega lažjega »dostopa do pravice«, hitrega in učinkovitega reševanja sporov izven sodne dvorane in s tem posledično povečanega zaupanja potrošnika v sam trg. Evropska unija je spomladi 2013 sprejela Uredbo o spletnem reševanju potrošniških sporov in Direktivo o alternativnem reševanju potrošniških sporov, ki sta naslednji povsem direktni korak povezave potrošništva in omenjenih metod reševanja sporov. Glavni namen nove ureditve je zagotoviti vsem potrošnikom hitro in cenovno učinkovito pot do razrešitve konfliktov brez dolgotrajnih sodnih postopkov, in sicer v vseh oblikah sporov, ki jih imajo potrošniki s trgovci, najsi bodo to pogodbena razmerja med domačimi akterji ali pa čezmejna razmerja. Do konca leta 2015 naj bi pričela »obratovati« še enotna vseevropska spletna platforma, ki bi delovala kot »aktivni vmesnik« za spletno obravnavo potrošniških sporov.

Title:ALTERNATIVE DISPUTE RESOLUTION FOR CONSUMERS AND NEW TRENDS OF ONLINE DISPUTE RESOLUTION
Abstract:Consumerism is the basic premise of the contemporary economic system and the consumer is essential to the survival of the existing world, and European, economy. The world and the European Union have met with the contemporary concept of the consumer as a key stakeholder and propellant of the economy in the 1950s, whereas a little later, in the 70s, an intensive debate surrounding and a formalization of the basic consumer rights began, which through the growing awareness of the public have been gaining power since then. One of the so-called universal consumer rights is also the right to legal protection. The diploma thesis addresses the currently most contemporary approach to consumer protection, namely alternative dispute resolution and the new trend of resolving disputes over the internet. Alternative dispute resolution (ADR) comprises informal procedures of dispute resolution, where the parties try to resolve the dispute with the help of a third party specialist. The main advantages of ADR are speed of procedure and attainable cost. The approaches of ADR are constantly evolving and alongside the revolution of the World Wide Web, the concept of dispute resolution over the internet has evolved. Thus, the acronym ODR (Online dispute resolution) denotes the mechanisms of alternative conflict resolution using the World Wide Web. In Slovenia the acronym SRS is used. The most important effect of the use of ADR and ODR procedures has purportedly been improved market operation, mostly because of the ensuing easier »access to justice«, a quick and effective dispute resolution outside the court and with this the consumer's increased trust in the market. In spring 2013, the European Union accepted the Regulation on the internet resolution of consumer disputes and the Directive on the alternative resolution of consumer disputes, which are the next direct steps in forming the connection between consumerism and the above-mentioned methods of dispute resolution. The main aim of the new arrangement is providing all consumers with a quick and cost effective way of resolving disputes without long court procedures, and in all forms of disputes between consumers and commercial traders, in both inland and cross-border contractual relationships. By the end of 2015, the uniformed all-European web platform should be in operation, acting as an »active interface« for the alternative dispute resolution of consumer disputes over the internet.
