Title:Zagotavljanje prič pri osebnih in hišnih preiskavah : diplomsko delo visokošolskega strokovnega študija Varnost in policijsko delo

Abstract:Diplomsko delo prvenstveno obravnava sistemsko ureditev in težave, s katerimi se preiskovalci srečujejo pri zagotavljanju prič pri hišnih in osebnih preiskavah v Republiki Sloveniji. Ker z izvedbo omenjenih preiskav posegajo v človekove pravice in temeljne svoboščine, smo najprej predstavili razvoj omenjenih pravic in definirali, v katero izmed pravic posegajo z opravo posamezne preiskave. Nekoliko podrobneje smo predstavili ureditev poteka preiskav, in sicer od pogojev za preiskavo in izdaje sodne odredbe do predstavitve pravic oseb pri takšnih preiskavah. Ustava Republike Slovenije (1991) in Zakon o kazenskem postopku (1994) področju zagotavljanja prič pri preiskavah namenjata zelo malo pozornosti, zaradi česar so preiskovalci prepuščeni lastni iznajdljivosti. Šele odločitve Vrhovnega sodišča Republike Slovenije so nakazale določene standarde in obravnavani pravici dale določene vsebine oziroma zapolnile omenjeno vrzel. Analize sodb Evropskega sodišča za človekove pravice in sistemskih ureditev hišnih in osebnih preiskav v 14 članicah Evropske unije so pokazale, da Republika Slovenija poleg Republike Bolgarije preiskovancem na obravnavanem področju zagotavlja največjo zaščito med vsemi obravnavanimi članicami. Zadnje poglavje diplomskega dela smo namenili razpravi in nanizali nekaj predlogov, s katerimi bi lahko določneje uredili področje zagotavljanja prič pri hišnih in osebnih preiskavah. Na ta način bi namreč preiskovalcem olajšali delo, ti pa bilo lahko svojo energijo usmerili v temeljitost izvedbe preiskav.

Abstract:The thesis primarily discusses the systemic regulation and problems, faced by investigators in providing witnesses at house and personal searches during investigations in the Republic of Slovenia. Since the execution of the named search interferes with personal rights and fundamental freedoms, we first presented the development of these rights and defined, with which of these rights we are interfering with individual searches. We more thoroughly presented the regulation of the course of searches, namely from the conditions for the search, the issuing of the court order to the presentation of the rights of persons in such searches. The Constitution of the Republic of Slovenia (1991) and the Criminal Procedure Act (1994) devote little attention to the field of providing witnesses at searches; therefore investigators are left to their own ingenuity. Only the decisions of the Supreme Court of the Republic of Slovenia indicated certain standards and provided certain content for the mentioned right or filled the mentioned gap. Analyses of judgments of the European Court of Human Rights and of systemic regulations of house and personal searches in 14 EU member states showed that the Republic of Slovenia besides the Republic of Bulgaria provides the inquired at the discussed field with the largest protection among all discussed member states. The final chapter of the thesis is devoted to discussion, where we provided some suggestion, with which we could more thoroughly regulate the field of providing witnesses at house and personal researches. This way we would simplify the work of investigators and they could direct more energy into the thoroughness of investigations.
