Abstract:Danes je v mednarodni praksi splošno sprejet položaj Svetega sedeža kot subjekta mednarodnega prava, ki je glede bistvenih značilnosti, kot sta pogodbena sposobnost in pravica poslanstva, izenačen s položajem držav. Sveti sedež je skozi stoletja pridobil pomemben mednarodni položaj, vendar danes ni povsem jasno, ali je ta status pridobil kot vrhovni poglavar katoliške Cerkve ali morda kot vladar majhne države Vatikan. Mednarodnopravni status Svetega sedeža, Vatikanskega mesta in papeža je predmet mnogih razlag. Papežu kot poglavarju rimskokatoliške Cerkve pripisujejo enak položaj kot šefu katerekoli države, zato uživa privilegije in imunitete ter časti, ki se izkazujejo šefu države. Sveti sedež je osrednji upravni organ katoliške Cerkve, ki ga sestavljajo papež, zbor kardinalov, državni tajnik in drugi organi, zadolženi za upravljanje katoliške Cerkve. Vatikansko mesto s svojim zelo majhnim ozemljem in maloštevilnim prebivalstvom, ki ga sestavljajo predvsem cerkveni dostojanstveniki in drugi uslužbenci, daje Svetemu sedežu simbolično teritorialno dimenzijo. Vendar po standardnih kriterijih državnosti ni možno opisati niti Svetega sedeža niti Vatikanskega mesta kot državo. Medtem ko se teoretične diskusije nadaljujejo glede zahtev za mednarodno subjektiviteto in glede opredelitve države v mednarodnem pravu, je Sveti sedež splošno sprejet kot mednarodnopravni subjekt, čeprav z atipičnim statusom v mednarodnih odnosih. Sveti sedež je pogodbena stranka različnih mednarodnih pogodb, je član mnogih mednarodnih organizacij ter aktivno nastopa v Organizaciji združenih narodov. Vprašanje posebnih medsebojnih odnosov Svetega sedeža in Vatikanskega mesta v praksi ni bistveno, saj države sklepajo mednarodne pogodbe in vzpostavljajo diplomatske odnose le s Svetim sedežem.

Title:LEGAL STATUS OF THE HOLY SEE VATICAN CITY AND POPE IN INTERNATIONAL LAW
Abstract:In the international practice today, the position of the Holy See is generally accepted as a subject of international law, which (according to the essential characteristics, such as a contractual ability and the right of legation) equals the status of countries. The Holy See has gained significant international position for centuries but today it is not entirely clear whether this status has been acquired as the supreme commander of the Catholic Church, or perhaps as a ruler of a small country Vatican. International legal status of the Holy See, Vatican City, and the Pope is subject of many discussions. The Pope as the chief of Roman Catholic Church enjoys the same privileges, immunities, and honours which are recognized to the boss of any country. The Holy See is the central administrative authority of the Catholic Church, which is composed of the Pope, the College of Cardinals, Secretary of State, and other bodies responsible for the management of the Catholic Church. Vatican City with its very small territory and small population, which consists primarily of church officials and other staff, represents a symbolic territorial dimension of the Holy See. However, according to standard criteria of statehood neithter the Holy See nor the Vatican City can be described as a country. While theoretical discussions continue regarding the requirements for international subjectivity and the definition of the subject in international law, the Holy See is generally accepted as an international entity, albeit with atypical status in international relations. The Holy See is a party to various international treaties; it is a member of many international organizations and actively performs in the United Nations. In practice, the issue of special mutual relations of the Holy See and Vatican City is not essential because countries conclude international treaties and establish diplomatic relations only with the Holy See.
