Abstract:Mednarodno pravo dosega najvišjo stopnjo uporabnosti na področju mirnega reševanja mednarodnih sporov. V teoriji in praksi se delijo na politične in pravne spore. V diplomskem delu so predstavljena diplomatska sredstva mirnega reševanja mednarodnih sporov. Osnovi vpogled v sredstva za mirno reševanje mednarodnih sporov daje 33. člen Ustanovne listine Zdruţenih narodov, ki poleg pravnih sredstev navaja tudi tipična diplomatska sredstva. Ta so: pogajanja, preiskava, sprava in posredovanje. Pri tem je potrebno izpostaviti dobre usluge, ki jih Ustanovna listina ne navaja izrecno kot posamezno diplomatsko sredstvo. Ta v oţjem smislu ne loči posredovanja od dobrih uslug. Pojem posredovanja v Ustanovni listini je uporabljen v širšem smislu in zavzema obe sredstvi hkrati, pri tem pa ne podaja vsebinskih razlik. Diplomatska sredstva so torej: pogajanja, dobre usluge, posredovanje, preiskava in sprava. Politični spori so po naravi tako občutljivi, da stranki ne moreta prepustiti spora organu, ki o njem odloča na podlagi prava. Značilni politični spori zadevajo vitalne interese drţave, prestiţ, čast drţave, drţavno ozemlje. V takšnih primerih so najbolj primerna diplomatska sredstva mirnega reševanja mednarodnih sporov. Diplomatska sredstva so zelo prilagodljiva, odlikujeta jih hitrost in zaupnost. Rešitev spora ni pravno obvezujoča za stranki v sporu. Diplomatska sredstva je moţno kombinirati med sabo ali z drugimi pravnimi sredstvi. Njihov namen je lajšati doseganje soglasja med strankami. Zato takšne rešitve nimajo zavezujočega značaja in je kljub morebitnim pravnim platem spora cilj kompromis med strankama. S pravnega vidika njihov pravno neobvezujoči izid predstavlja bistveno značilnost diplomatskih sredstev.

Title:DIPLOMATIC METHODS OF INTERNATIONAL DISPUTE SETTLEMENT
Abstract:International law reaches the highest usability in the field of peaceful settlement of international disputes. In theory and practice are disputes divided on political and legal disputes. The diploma paper presents diplomatic means of peaceful settlement of international disputes. A basic insight into the means for the peaceful settlement of international disputes gives Article 33 of the Charter of the United Nations, which states legal means and typical diplomatic means. These are negotiation, inquiry, conciliation and mediation. It is necessary to point out good offices, which is not stated as diplomatic means in the Charter. The Charter of the United Nations in the narrower sense does not distinguish between mediation and good offices. The concept of mediation in the Charter is used in a broader sense and takes both means at the same time while it does not make any substantive differences. Diplomatic means are negotiations, good offices, mediation, inquiry and conciliation. Political disputes are naturally very sensitive and the parties cannot leave it to another authority which would solve the dispute on the basis of the law. Typical political disputes are concerning the vital interests of the State, prestige, honour of the State and state territory. In these disputes are the most appropriate diplomatic means of peaceful settlement of international disputes. Diplomatic means are very flexible, they are very fast and confidential. Settlement of the dispute is not legally binding for the parties in dispute. Diplomatic means can be combined with each other or with other legal means. Their purpose is to reach the settlement of the dispute between the parties. Therefore, such settlements of a dispute do not have a binding nature, and despite the legal side of the dispute, the goal is to reach a settlement. From a legal point of view, their non-legally binding outcome represents the main characteristic of diplomatic means.
