Title:RAZVOJ ENOTNEGA EVROPSKEGA PATENTA IN NJEGOV VPLIV NA POSLOVANJE PODJETIJ

Abstract:Po več kot tridesetih letih pogajanj je 25 članic Evropske unije februarja 2013 doseglo zgodovinski dogovor na patentnem področju. Sprejet in podpisan je bil še zadnji manjkajoči del Patentnega svežnja EU – Sporazum o enotnem patentnem sodišču – in enotnemu patentu EU so se končno na široko odprla vrata. V času, ko intelektualna lastnina pridobiva na pomenu in imajo patenti vse večjo konkurenčno in ekonomsko vrednost, se zdi podpis Sporazuma pomembnejši kot kadarkoli prej. Enotni patent prinaša mnogo prednosti za podjetja, predvsem mala in srednje velika. Predvideva zmanjševanje stroškov za kar 80 %, enostavnejše postopke pridobitve, uporabnikom prijaznejši jezikovni aranžma in bolj pregledno ureditev pravnega področja. Nov patentni sistem pomeni nove izzive za podjetja, strokovnjaki opozarjajo, da ne vedno tista v pozitivnem smislu. Povečano število patentov pomeni večje možnosti izrabljanja sistema in neetičnega poslovnega vedenja. Še posebej zaskrbljujoči so tako imenovani patentni škrati in izkoriščanje pravnega sistema v svoj prid – »forum shopping«. Evropska unija in podjetja, ki delujejo znotraj njenih meja, se bodo morala naučiti delovati v novih okoliščinah, ko svet postaja vse bolj integriran in globaliziran. Ali se bodo uresničile pozitivne napovedi predstavnikov Evropske unije ali tiste bolj črnoglede, bomo lahko videli v prihodnje, ko bodo podeljeni prvi enotni patenti EU.

Title:SINGLE EUROPEAN PATENT AND ITS IMPACT ON BUSINESS OPERATIONS
Abstract:After more than thirty years of negotiations, the 25 Member States of the European Union, have reached a historic agreement on the patent field in February 2013. The last missing part of the EU Patent Package was accepted and signed - Agreement on unitary patent court - and the single EU patent have finally opened the floodgates. At the time as intellectual property is gaining in importance and the patents have increasing competitive and economic value, it seems that the signature of the Agreement is more important than ever. Unitary patent brings many advantages for businesses, particularly for small and medium-sized. It predicts a reduction of costs for 80%, simple procedures for acquisitions, more user-friendly language package and more manageable regulation of the legal field. The new patent system means new challenges for businesses, but experts warn that it is not always the one in a positive way. Increased number of patents means more opportunities to exploit the system and unethical business behavior. Particularly worrying are the so-called patent trolls and the exploitation of the legal system to their advantage - forum shopping. The European Union and the businesses that are operating within its borders will have to learn to operate in new circumstances, as the world is becoming more integrated and globalized. If the positive predictions of the European Union representatives come true, or those that are more pessimistic, we will see in the future, when the first single EU patent will be given.
