Title:NAJPOGOSTEJE KRŠENE PRAVICE DELAVCEV

Abstract:Na Inšpektoratu RS za delo ter na uradu Varuha za človekove pravice iz leta v leto beležijo povečane prilive novih zadev, povezanih s kršitvijo pravic iz delovnega razmerja. Najpogosteje se pojavljajo kršitve pravic delavcev na področju plačila za delo in ostalih prejemkov iz delovnega razmerja, tovrstne kršitve so najštevilčnejše od pričetka gospodarske krize. Inšpektorji ugotavljajo številne nepravilnosti na področju pogodb o zaposlitvi (zavlačevanje sklenitve pogodbe o zaposlitvi za nedoločen čas, siljenje zaposlenih v pridobivanje statusa samostojnega podjetnika), nepravilnosti na področju zagotavljanja varnega in zdravega dela (pomanjkljivo usposabljanje zaposlenih, neredni zdravniški pregledi), kršitve na področju delovnega časa, odmorov ter počitkov. Kršitve se pojavljajo tudi na področju odpovedi pogodbe o zaposlitvi ter glede letnega dopusta. Vse pogosteje se inšpektorji, pa tudi Varuh človekovih pravic, srečujejo s psihosocialnimi dejavniki tveganja na delovnem mestu, kot so trpinčenje, šikaniranje, »mobing«, diskriminacija. V raziskavi smo s pomočjo anketnega vprašalnika pridobili izkušnje delavcev ter njihova stališča o najpogosteje kršenih pravicah delavcev. Rezultati kažejo na podobnost z ugotovitvami Inšpektorata RS za delo.

Title:FREQUENTLY VIOLATED WORKERS RIGHTS
Abstract:The number of new cases of violating employment rights, that Labour inspectorate of Republic of Slovenia and Human rights ombudsman receive, is increasing yearly. The most frequently violated workers rights are related to salaries and other employment earnings. Such violations are the most numerous since the beginning of the economic crisis. Inspectors also found numerous irregularities related to employment contracts (delaying the conclusion of an indefinite employment contract, forcing employees to obtain the status of entrepreneur), irregularities in providing occupational safety and health (lack of staff training, irregular medical examinations), and violations, related to working hours, breaks and rest periods. Also, there are plenty of violations, related to terminations of employment contracts, and to annual leave. Inspectors and the Ombudsman are increasingly facing psychosocial risk factors in the work place, such as bullying, harassment, mobbing and discrimination. In this study we used a questionnaire to gain some experience that workers have about violating their rights and their view on the most frequently violated workers rights. The results show the similarity with findings of the Labour inspectorate of Republic of Slovenia.
