Abstract:Pravica do svobode ustanavljanja je za sodobno mednarodno trgovino zelo pomembna. Določa jo Pogodba o delovanju Evropske unije in jo uvrščamo med prosto gibanje oseb ter predstavlja eno izmed temeljnih svoboščin notranjega trga Evropske unije. Že od vsega začetka pomembno vlogo pri razlagi te pravice igra Sodišče Evropske unije. Tudi sodba v zadevi Ottica New Line je pomemben precedens, saj predstavlja nadaljevanje sodne prakse o nacionalnih ukrepih, ki uresničevanje svobode ustanavljanja v okviru poklicev, ki so povezani z javnim zdravjem, pogojuje s sistemom predhodnega dovoljenja, ki pomeni omejitev. V prvem poglavju diplomskega dela se zaradi lažjega razumevanja sodbe v zadevi Ottica naprej seznanimo z vsebino svobode ustanavljanja, z dopustnimi omejitvami ali izjemami in z razmejitvijo do ostalih svoboščin. Omejitev svobode je lahko upravičena z višjimi razlogi v splošnem interesu, ki se nanašajo na javno zdravje. V drugem delu diplomske naloge se bomo seznanili z najpomembnejšimi precedensi Sodišča EU na področju javnega zdravstva, ki so pomembno vplivali na odločitev v zadevi Ottica New Line. V zadnjem poglavju diplomskega dela pa bomo podrobneje spoznali zadevo Ottica, kjer Sodišče Evropske unije v predlogu za sprejetje predhodne odločbe odloči o utemeljenosti omejevanja svobode ustanavljanja v primeru mešanih dejavnosti, konkretneje prodajaln z optičnimi pripomočki.

Title:FREEDOM OF ESTABLISHMENT AFTER THE DECISION OF THE EUROPEAN COURT OF JUSTICE IN THE CASE OF OTTICA NEW LINE
Abstract:Freedom of establishment is very important for modern international trade. It is specified in the Treaty on the Functioning of the European Union and is classified under the free movement of people. It is one of the fundamental rights of the European internal market. Since the very beginning, the European Court of Justice played a vital role in the interpretation of the freedom. The case Ottica New Line presents an important case-law concerning national measures on making the exercise of freedom of establishment, for professions linked to public health, subject to an authorization scheme which constitutes a restriction. For better understanding the Ottica New Line case, the first chapter of the paper presents the freedom of establishment, presents the exceptions on the freedom of establishment and how is it different to the other freedoms that are specified in the article 26 TFEU. The restriction of the freedom of establishment can be justified by reasons in the general interest that are related to public health. In the second part of the thesis, we get familiar with the most important precedents of the European Court of Justice that concern public health and had a significant influence on the decision in the Ottica New Line case. In the last chapter, we get to know in more detail the judgment in Ottica, where the European Court of Justice in the request for a preliminary ruling tries to justify the restriction on the freedom of establishment that were imposed by the Sicilian regional law.
