Title:VARSTVO OSEBNIH PODATKOV NA DELOVNEM MESTU

Abstract:Dandanes je informacijska tehnologija dosegla visok razvoj in s tem omogočila lažje zbiranje osebnih podatkov in njihovo obdelavo. Osebni podatki kažejo številne intimne in druge lastnosti ter razmerja posameznikov in pri tem je država tista, ki mora zagotoviti primerno varstvo. Ustava Republike Slovenije opredeljuje varstvo osebnih podatkov, kot eno izmed temeljnih človekovih pravic. Še bolj podrobno pa varstvo osebnih podatkov ureja Zakon o varstvu osebnih podatkov, ki določa, da so to katerikoli podatki, ki se nanašajo na posameznika, ne glede na obliko v kateri so izraženi. Ti podatki pridejo v ospredje predvsem na področju delovnega prava oz. delovnih razmerij, saj delodajalec skozi proces zaposlovanja zbira in obdeluje osebne podatke delavcev. Osebni podatki se lahko obdelujejo, če tako določa zakon ali pa je v obdelavo osebnih podatkov osebno privolil posameznik. Delodajalec je dolžan posamezniku omogočiti vpogled v katalog zbirke osebnih podatkov, ko pa odpadejo razlogi za zbiranje osebnih podatkov jih je potrebno zbrisati, uničiti, blokirati, anonimizirati,… Zakon podrobno določa tudi kaj so občutljivi podatki in kaj so prometni podatki, oboji imajo bistveno vlogo pri zbiranju evidenc osebnih podatkov. Poznamo različna tehnološka sredstva s katerimi se nadzirajo in pridobivajo osebni podatki. V zvezi z osebnimi podatki imamo sodno prakso, tako slovensko kakor tudi evropsko, ki daje odgovore na različna vprašanja glede varstva osebnih podatkov. Pogosto se dogaja, da se na tem področju kršijo pravila, ki pa jih je potrebno primerno kazensko in civilno sankcionirati. Različne države urejajo varstvo osebnih podatkov na različne načine.

Title:EMPLOYEE'S DATA PROTECTION
Abstract:Today, information technology has reached a high development and thus makes it easier to collect personal data and it’s processing. Personal data show a number of intimate and other properties and relationships of individuals. Country should provide adequate protection. The Constitution of the Republic of Slovenia defines the protection of personal data as a fundamental human right. Even more particularly, the protection of personal data is governed by the Law on Protection of Personal Data, which states that personal data is any information relating to an individual, regardless of the form in which it is expressed. These data are important in labor law as the employer through the employment process collects and processes personal data of workers. Personal data may be processed if law requires or this approves individual worker. The employer is obliged to enable the individual to view the catalog of the collection of personal data. But when there is lack of reasons for collecting personal information personal data has to be deleted, destroyed, blocked, anonymised,… The Act also specifies what information is sensitive and what is traffic data, both of them plays a vital role in the collection of records of personal data. There are different technological ways with which to control and acquire data. With regard to the personal data we have Slovenian and European case law, which provides answers to various questions concerning the protection of personal data. It often happens violation of the rules, but there must be appropriate criminal and civil penalty. Different countries rule the protection of personal data in different ways.
